55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring the comptroller of public accounts to
88 establish and maintain a political subdivision disaster
99 expenditure database.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 403, Government Code, is
1212 amended by adding Section 403.0243 to read as follows:
1313 Sec. 403.0243. POLITICAL SUBDIVISION DISASTER EXPENDITURE
1414 DATABASE. (a) In this section:
1515 (1) "Disaster" has the meaning assigned by Section
1616 418.004.
1717 (2) "Political subdivision" means a county,
1818 municipality, school district, junior college district, other
1919 special district, or other subdivision of state government.
2020 (b) The comptroller shall establish and maintain on the
2121 Internet an electronically searchable database that contains the
2222 following information for each political subdivision:
2323 (1) the total amount budgeted by the political
2424 subdivision for disaster preparedness, response, rebuilding, and
2525 mitigation in the most recent fiscal year of the political
2626 subdivision that is complete;
2727 (2) the total amount spent by the political
2828 subdivision for disaster preparedness, response, rebuilding, and
2929 mitigation in the most recent fiscal year of the political
3030 subdivision that is complete; and
3131 (3) the total amount received by the political
3232 subdivision for disaster preparedness, response, rebuilding, and
3333 mitigation in the most recent fiscal year of the political
3434 subdivision that is complete from the following categories, stated
3535 as a total amount and a per category amount:
3636 (A) the federal government;
3737 (B) the state government;
3838 (C) another public entity, including another
3939 political subdivision; and
4040 (D) a private entity, including an insurance
4141 company or nonprofit charitable organization.
4242 (c) The comptroller shall update the information in the
4343 database for a political subdivision not later than the 45th day
4444 after the date on which the comptroller receives a report from the
4545 political subdivision under Subsection (d).
4646 (d) Each political subdivision shall, at the close of the
4747 political subdivision's fiscal year, prepare and file with the
4848 comptroller an annual report that contains for that fiscal year the
4949 information described by Subsection (b). Each political
5050 subdivision must file the report required by this subsection in a
5151 form and in the manner prescribed by the comptroller. The
5252 comptroller shall prepare a form for the report required by this
5353 subsection.
5454 (e) The comptroller shall establish procedures and adopt
5555 rules to implement this section.
5656 SECTION 2. The comptroller of public accounts shall:
5757 (1) prepare and make available the form required by
5858 Section 403.0243(d), Government Code, as added by this Act, not
5959 later than October 1, 2019; and
6060 (2) establish and post on the Internet the database
6161 required by Section 403.0243, Government Code, as added by this
6262 Act, not later than September 1, 2020.
6363 SECTION 3. The first report required of a political
6464 subdivision under Section 403.0243(d), Government Code, as added by
6565 this Act, must be filed with the comptroller of public accounts at
6666 the close of the political subdivision's 2019 fiscal year.
6767 SECTION 4. This Act takes effect September 1, 2019.
