7 | 7 | | relating to the operations and functions of the Veterans' Land |

8 | 8 | | Board and the sunset review date for and programs administered by |
---|
9 | 9 | | the board. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 161.0111, Natural Resources Code, is |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | Sec. 161.0111. SUNSET PROVISION. The Veterans' Land Board |
---|
14 | 14 | | is subject to review under Chapter 325, Government Code (Texas |
---|
15 | 15 | | Sunset Act), but is not abolished under that chapter. The board |
---|
16 | 16 | | shall be reviewed during the period in which state agencies |
---|
17 | 17 | | abolished in 2031 are reviewed [2019] and every 12th year after that |
---|
18 | 18 | | [2019 are reviewed]. |
---|
19 | 19 | | SECTION 2. Subchapter B, Chapter 161, Natural Resources |
---|
20 | 20 | | Code, is amended by adding Section 161.0141 to read as follows: |
---|
21 | 21 | | Sec. 161.0141. SEPARATION OF RESPONSIBILITIES. The board |
---|
22 | 22 | | shall develop and implement policies that clearly separate the |
---|
23 | 23 | | policy-making responsibilities of the board and the management |
---|
24 | 24 | | responsibilities of the executive secretary, assistant executive |
---|
25 | 25 | | secretary, and staff of the board. |
---|
26 | 26 | | SECTION 3. Section 161.023, Natural Resources Code, is |
---|
27 | 27 | | amended by amending Subsection (b) and adding Subsection (d) to |
---|
28 | 28 | | read as follows: |
---|
29 | 29 | | (b) The training program must provide the person with |
---|
30 | 30 | | information regarding: |
---|
31 | 31 | | (1) the law governing board operations [the |
---|
32 | 32 | | legislation that created the board]; |
---|
33 | 33 | | (2) the programs, functions, rules, and budget of the |
---|
34 | 34 | | board; |
---|
35 | 35 | | (3) the scope of and limitations on the rulemaking |
---|
36 | 36 | | authority of the board; |
---|
37 | 37 | | (4) the results of the most recent formal audit of the |
---|
38 | 38 | | board; |
---|
39 | 39 | | (5) [(4)] the requirements of: |
---|
40 | 40 | | (A) laws relating to open meetings, public |
---|
41 | 41 | | information, administrative procedure, and disclosure of conflicts |
---|
42 | 42 | | of interest; and |
---|
43 | 43 | | (B) other laws applicable to members of a state |
---|
44 | 44 | | policy-making body in performing their duties; and |
---|
45 | 45 | | (6) [(5)] any applicable ethics policies adopted by |
---|
46 | 46 | | the board or the Texas Ethics Commission. |
---|
47 | 47 | | (d) The commissioner shall create a training manual that |
---|
48 | 48 | | includes the information required by Subsection (b). The |
---|
49 | 49 | | commissioner shall distribute a copy of the training manual |
---|
50 | 50 | | annually to each member of the board. On receipt of the training |
---|
51 | 51 | | manual, each member of the board shall sign and submit to the |
---|
52 | 52 | | commissioner a statement acknowledging receipt of the training |
---|
53 | 53 | | manual. |
---|
54 | 54 | | SECTION 4. Section 161.031(a), Natural Resources Code, is |
---|
55 | 55 | | amended to read as follows: |
---|
56 | 56 | | (a) The executive secretary or his or her designee shall |
---|
57 | 57 | | prepare and maintain a written plan to assure implementation of a |
---|
58 | 58 | | program of equal employment opportunity whereby all personnel |
---|
59 | 59 | | transactions are made without regard to race, color, disability |
---|
60 | 60 | | [handicap], sex, religion, age, or national origin. The plan shall |
---|
61 | 61 | | include: |
---|
62 | 62 | | (1) a comprehensive analysis which meets federal and |
---|
63 | 63 | | state guidelines of all the agency's work force by race, sex, ethnic |
---|
64 | 64 | | origin, class of position, and salary or wages; |
---|
65 | 65 | | (2) plans for recruitment, evaluation, selection, |
---|
66 | 66 | | appointment, training, promotion, and other personnel policies; |
---|
67 | 67 | | (3) procedures by which a determination can be made of |
---|
68 | 68 | | significant underutilization in the agency work force of all |
---|
69 | 69 | | persons for whom federal and state guidelines encourage a more |
---|
70 | 70 | | equitable balance and steps reasonably designed to overcome any |
---|
71 | 71 | | identified underutilization; and |
---|
72 | 72 | | (4) objectives and goals, with appropriate timetables |
---|
73 | 73 | | for the achievement of the objectives and goals, assignments of |
---|
74 | 74 | | responsibility for their achievement, and an appropriate program |
---|
75 | 75 | | for reviewing and maintaining these goals and objectives once |
---|
76 | 76 | | achieved. |
---|
77 | 77 | | SECTION 5. (a) Except as provided by Subsection (b) of this |
---|
78 | 78 | | section, Section 161.023, Natural Resources Code, as amended by |
---|
79 | 79 | | this Act, applies to a member of the Veterans' Land Board appointed |
---|
80 | 80 | | before, on, or after the effective date of this Act. |
---|
81 | 81 | | (b) A member of the Veterans' Land Board who, before the |
---|
82 | 82 | | effective date of this Act, completed the training program required |
---|
83 | 83 | | by Section 161.023, Natural Resources Code, as that law existed |
---|
84 | 84 | | before the effective date of this Act, is required to complete |
---|
85 | 85 | | additional training only on subjects added by this Act to the |
---|
86 | 86 | | training program as required by Section 161.023, Natural Resources |
---|
87 | 87 | | Code, as amended by this Act. A board member described by this |
---|
88 | 88 | | subsection may not vote, deliberate, or be counted as a member in |
---|
89 | 89 | | attendance at a meeting of the board held on or after December 1, |
---|
90 | 90 | | 2019, until the member completes the additional training. |
---|
91 | 91 | | SECTION 6. This Act takes effect September 1, 2019. |
