| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 250, Local Government Code, is amended | |
| 11 | 11 | by adding Section 250.009 to read as follows: | |
| 12 | 12 | Sec. 250.009. WORKING ANIMAL BAN PROHIBITED. A county or | |
| 13 | 13 | municipality may not adopt or enforce a charter provision, | |
| 14 | 14 | ordinance, order, or other regulation that prohibits, directly or | |
| 15 | 15 | indirectly, the use of an animal for the purpose of performing a | |
| 16 | 16 | specific duty for a business, including entertainment, | |
| 17 | 17 | transportation, education, or exhibition. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2019. |
