96 AN ACT
10- relating to an attorney identification card for entrance into a
11- building that houses a court; authorizing a fee.

8+ court by presentation of the attorney's state bar membership card.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Chapter 75, Government Code, is amended by
1411 adding Subchapter J to read as follows:
1512 SUBCHAPTER J. ACCESS TO BUILDINGS THAT HOUSE COURTS
1613 Sec. 75.601. STATE BAR MEMBERS. (a) To enter a building
1714 that houses a justice court, municipal court, county court, county
1815 court at law, or district court without passing through security
1916 services, an attorney licensed to practice law in this state may
20- present the attorney's security services identification card
21- issued under Section 81.117 instead of an identification card
22- issued or authorized for issuance by a county or municipality.
17+ present the attorney's state bar membership card instead of an
18+ identification card issued or authorized for issuance by a county
19+ or municipality.
2320 (b) A county or municipality may not adopt or enforce an
2421 order or ordinance that conflicts with Subsection (a).
25- SECTION 2. Subchapter H, Chapter 81, Government Code, is
26- amended by adding Section 81.117 to read as follows:
27- Sec. 81.117. SECURITY SERVICES IDENTIFICATION CARD. (a)
28- The state bar in accordance with this section may issue to a member
29- of the state bar a security services identification card that
30- authorizes the member to enter a building that houses a court
31- without passing through security services as provided by Section
32- 75.601. The identification card:
33- (1) may be in an electronic or a physical format; and
34- (2) must include a photograph of the member taken
35- within the five years preceding the date of the card's issuance.
36- (b) A member of the state bar may apply for issuance of a
37- security services identification card by submitting to the state
38- bar:
39- (1) an application on a form prescribed by the state
40- bar;
41- (2) a form prescribed by the state bar authorizing the
42- state bar to obtain criminal history record information on the
43- applicant; and
44- (3) a reasonable fee in the amount set by the state bar
45- to cover the costs of implementing this section, including the
46- portion of the fee to be remitted to a county in accordance with
47- Subsection (c).
48- (c) The state bar shall remit a portion of each fee
49- collected under this section in an amount not less than $50 as
50- prescribed by state bar rules to the county treasurer, or person
51- performing the functions of the county treasurer, of the county of
52- the applicant's primary practice location. The county may use
53- money the county receives under this subsection only for court
54- security purposes.
55- (d) The state bar shall adopt rules to implement this
56- section, including rules:
57- (1) on the collection and distribution of fees;
58- (2) for the approval, denial, and revocation of a
59- security services identification card; and
60- (3) to establish a committee to:
61- (A) review security services identification card
62- applications submitted by and criminal history record information
63- obtained concerning members of the state bar; and
64- (B) oversee:
65- (i) the collection and distribution of fees
66- in accordance with this section and rules adopted under this
67- section; and
68- (ii) the approval, denial, and revocation
69- of a security services identification card.
70- SECTION 3. Section 411.1005, Government Code, is amended by
71- adding Subsection (a-1) to read as follows:
72- (a-1) The State Bar of Texas is entitled to obtain from the
73- department criminal history record information maintained by the
74- department that relates to a person who:
75- (1) is licensed by the state bar; and
76- (2) applies for issuance of a security services
77- identification card under Section 81.117.
78- SECTION 4. Section 291.010, Local Government Code, is

83- SECTION 5. As soon as practicable after the effective date
84- of this Act, the State Bar of Texas shall adopt the rules, fees,
85- forms, and procedures necessary to implement this Act.
86- SECTION 6. This Act takes effect September 1, 2019.
