66 AN ACT
77 relating to prevention of communicable diseases in certain
88 long-term care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 81.003, Health and Safety Code, is
1111 amended by amending Subdivision (4-a) and adding Subdivision (4-b)
1212 to read as follows:
1313 (4-a) "Long-term care facility" means a facility
1414 licensed or regulated under Chapter 242, 247, or 252.
1515 (4-b) "Peace officer" has the meaning assigned by
1616 Article 2.12, Code of Criminal Procedure. The term includes a
1717 sheriff or constable.
1818 SECTION 2. Subchapter A, Chapter 81, Health and Safety
1919 Code, is amended by adding Sections 81.014 and 81.015 to read as
2020 follows:
2121 Sec. 81.014. LONG-TERM CARE FACILITY INFECTION PREVENTION
2222 AND CONTROL PROGRAM. (a) Each long-term care facility's infection
2323 prevention and control program must include:
2424 (1) monitoring of key infectious agents,
2525 including multidrug-resistant organisms;
2626 (2) procedures for communicating the presence of
2727 multidrug-resistant organism infections when admitting a resident
2828 to or transferring a resident from the facility; and
2929 (3) procedures for making rapid influenza diagnostic
3030 tests available to facility residents.
3131 (b) Subject to the confidentiality requirements of this
3232 chapter, the commission shall ensure that each long-term care
3333 facility's infection prevention and control program includes a
3434 requirement for the facility to report to the health authority or
3535 the department when two or more confirmed cases of influenza occur
3636 among facility residents within a 72-hour period.
3737 Sec. 81.015. ANTIMICROBIAL STEWARDSHIP REGIONAL ADVISORY
3838 COMMITTEES. (a) The department shall establish a regional
3939 advisory committee in each public health region designated under
4040 Section 121.007 to address antimicrobial stewardship in long-term
4141 care facilities and to improve antimicrobial stewardship through
4242 collaborative action.
4343 (b) A regional advisory committee established under this
4444 section must include:
4545 (1) physicians;
4646 (2) directors of nursing or equivalent consultants
4747 with long-term care facilities;
4848 (3) public health officials knowledgeable about
4949 antimicrobial stewardship; and
5050 (4) other interested parties.
5151 SECTION 3. This Act takes effect September 1, 2019.
