7 | 7 | | relating to prevention of communicable diseases in certain |
---|
8 | 8 | | long-term care facilities. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 81.003, Health and Safety Code, is |
---|
11 | 11 | | amended by amending Subdivision (4-a) and adding Subdivision (4-b) |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (4-a) "Long-term care facility" means a facility |
---|
14 | 14 | | licensed or regulated under Chapter 242, 247, or 252. |
---|
15 | 15 | | (4-b) "Peace officer" has the meaning assigned by |
---|
16 | 16 | | Article 2.12, Code of Criminal Procedure. The term includes a |
---|
17 | 17 | | sheriff or constable. |
---|
18 | 18 | | SECTION 2. Subchapter A, Chapter 81, Health and Safety |
---|
19 | 19 | | Code, is amended by adding Sections 81.014 and 81.015 to read as |
---|
20 | 20 | | follows: |
---|
21 | 21 | | Sec. 81.014. LONG-TERM CARE FACILITY INFECTION PREVENTION |
---|
22 | 22 | | AND CONTROL PROGRAM. (a) Each long-term care facility's infection |
---|
23 | 23 | | prevention and control program must include: |
---|
24 | 24 | | (1) monitoring of key infectious agents, |
---|
25 | 25 | | including multidrug-resistant organisms; |
---|
26 | 26 | | (2) procedures for communicating the presence of |
---|
27 | 27 | | multidrug-resistant organism infections when admitting a resident |
---|
28 | 28 | | to or transferring a resident from the facility; and |
---|
29 | 29 | | (3) procedures for making rapid influenza diagnostic |
---|
30 | 30 | | tests available to facility residents. |
---|
31 | 31 | | (b) Subject to the confidentiality requirements of this |
---|
32 | 32 | | chapter, the commission shall ensure that each long-term care |
---|
33 | 33 | | facility's infection prevention and control program includes a |
---|
34 | 34 | | requirement for the facility to report to the health authority or |
---|
35 | 35 | | the department when two or more confirmed cases of influenza occur |
---|
36 | 36 | | among facility residents within a 72-hour period. |
---|
37 | 37 | | Sec. 81.015. ANTIMICROBIAL STEWARDSHIP REGIONAL ADVISORY |
---|
38 | 38 | | COMMITTEES. (a) The department shall establish a regional |
---|
39 | 39 | | advisory committee in each public health region designated under |
---|
40 | 40 | | Section 121.007 to address antimicrobial stewardship in long-term |
---|
41 | 41 | | care facilities and to improve antimicrobial stewardship through |
---|
42 | 42 | | collaborative action. |
---|
43 | 43 | | (b) A regional advisory committee established under this |
---|
44 | 44 | | section must include: |
---|
45 | 45 | | (1) physicians; |
---|
46 | 46 | | (2) directors of nursing or equivalent consultants |
---|
47 | 47 | | with long-term care facilities; |
---|
48 | 48 | | (3) public health officials knowledgeable about |
---|
49 | 49 | | antimicrobial stewardship; and |
---|
50 | 50 | | (4) other interested parties. |
---|
51 | 51 | | SECTION 3. This Act takes effect September 1, 2019. |
