| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter B, Chapter 112, Transportation Code, | |
| 11 | 11 | is amended by adding Section 112.0571 to read as follows: | |
| 12 | 12 | Sec. 112.0571. CONSTRUCTION OF HIGH-SPEED RAIL. (a) In | |
| 13 | 13 | this section, "high-speed rail" has the meaning assigned by Section | |
| 14 | 14 | 112.201. | |
| 15 | 15 | (b) A private entity may not begin construction of a | |
| 16 | 16 | high-speed rail project unless the department has determined that | |
| 17 | 17 | the entity has acquired all real property necessary for the | |
| 18 | 18 | construction of the project. | |
| 19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2019. |
