9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the regulation of industrialized housing and buildings.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Section 1202.002(c), Occupations Code, is
814 amended to read as follows:
915 (c) Industrialized housing does not include:
1016 (1) [a residential structure that exceeds four stories
1117 or 60 feet in height;
1218 [(2)] housing constructed of a sectional or panelized
1319 system that does not use a modular component; or
1420 (2) [(3)] a ready-built home constructed in a manner
1521 in which the entire living area is contained in a single unit or
1622 section at a temporary location for the purpose of selling and
1723 moving the home to another location.
1824 SECTION 2. Section 1202.003(d), Occupations Code, is
1925 amended to read as follows:
2026 (d) An industrialized building includes a permanent
2127 commercial structure and a commercial structure designed to be
2228 transported from one commercial site to another commercial site but
2329 does not include [:
2430 [(1) a commercial structure that exceeds four stories
2531 or 60 feet in height; or
2632 [(2)] a commercial building or structure that is:
2733 (1) [(A)] installed in a manner other than on a
2834 permanent foundation; and
2935 (2) [(B)] either:
3036 (A) [(i)] not open to the public; or
3137 (B) [(ii)] less than 1,500 square feet in total
3238 area and used other than as a school or a place of religious
3339 worship.
3440 SECTION 3. This Act takes effect September 1, 2019.
