| 5 | 11 | | relating to the regulation of industrialized housing and buildings. |

| 6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 13 | | SECTION 1. Section 1202.002(c), Occupations Code, is |
|---|
| 8 | 14 | | amended to read as follows: |
|---|
| 9 | 15 | | (c) Industrialized housing does not include: |
|---|
| 10 | 16 | | (1) [a residential structure that exceeds four stories |
|---|
| 11 | 17 | | or 60 feet in height; |
|---|
| 12 | 18 | | [(2)] housing constructed of a sectional or panelized |
|---|
| 13 | 19 | | system that does not use a modular component; or |
|---|
| 14 | 20 | | (2) [(3)] a ready-built home constructed in a manner |
|---|
| 15 | 21 | | in which the entire living area is contained in a single unit or |
|---|
| 16 | 22 | | section at a temporary location for the purpose of selling and |
|---|
| 17 | 23 | | moving the home to another location. |
|---|
| 18 | 24 | | SECTION 2. Section 1202.003(d), Occupations Code, is |
|---|
| 19 | 25 | | amended to read as follows: |
|---|
| 20 | 26 | | (d) An industrialized building includes a permanent |
|---|
| 21 | 27 | | commercial structure and a commercial structure designed to be |
|---|
| 22 | 28 | | transported from one commercial site to another commercial site but |
|---|
| 23 | 29 | | does not include [: |
|---|
| 24 | 30 | | [(1) a commercial structure that exceeds four stories |
|---|
| 25 | 31 | | or 60 feet in height; or |
|---|
| 26 | 32 | | [(2)] a commercial building or structure that is: |
|---|
| 27 | 33 | | (1) [(A)] installed in a manner other than on a |
|---|
| 28 | 34 | | permanent foundation; and |
|---|
| 29 | 35 | | (2) [(B)] either: |
|---|
| 30 | 36 | | (A) [(i)] not open to the public; or |
|---|
| 31 | 37 | | (B) [(ii)] less than 1,500 square feet in total |
|---|
| 32 | 38 | | area and used other than as a school or a place of religious |
|---|
| 33 | 39 | | worship. |

| 34 | 40 | | SECTION 3. This Act takes effect September 1, 2019. |
