| 5 | 11 | | relating to the number of school marshals that may be appointed to |
|---|
| 6 | 12 | | serve on a public school campus or at a private school. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 37.0811(a), Education Code, is amended |
|---|
| 9 | 15 | | to read as follows: |
|---|
| 10 | 16 | | (a) The board of trustees of a school district or the |
|---|
| 11 | 17 | | governing body of an open-enrollment charter school may appoint one |
|---|
| 12 | 18 | | or more school marshals for each campus [not more than the greater |
|---|
| 13 | 19 | | of: |
|---|
| 14 | 20 | | [(1) one school marshal per 200 students in average |
|---|
| 15 | 21 | | daily attendance per campus; or |
|---|
| 16 | 22 | | [(2) for each campus, one school marshal per building |
|---|
| 17 | 23 | | of the campus at which students regularly receive classroom |
|---|
| 18 | 24 | | instruction]. |

| 19 | 25 | | SECTION 2. Section 37.0813(a), Education Code, is amended |
|---|
| 20 | 26 | | to read as follows: |
|---|
| 21 | 27 | | (a) The governing body of a private school may appoint one |
|---|
| 22 | 28 | | or more school marshals [not more than the greater of: |
|---|
| 23 | 29 | | [(1) one school marshal per 200 students enrolled in |
|---|
| 24 | 30 | | the school; or |
|---|
| 25 | 31 | | [(2) one school marshal per building of the school at |
|---|
| 26 | 32 | | which students regularly receive classroom instruction]. |
|---|
| 27 | 33 | | SECTION 3. This Act applies beginning with the 2019-2020 |
|---|
| 28 | 34 | | school year. |
|---|
| 29 | 35 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 30 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 39 | | Act takes effect September 1, 2019. |
