55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to immunity from certain disciplinary proceedings for a
88 teacher's justified use of physical force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.0512(b), Education Code, is amended
1111 to read as follows:
1212 (b) In this section, "disciplinary proceeding" means:
1313 (1) an action brought by the school district employing
1414 a professional employee of a school district to discharge or
1515 suspend the employee or terminate or not renew the employee's term
1616 contract; or
1717 (2) an action brought by the State Board for Educator
1818 Certification [to enforce the educator's code of ethics adopted
1919 under Section 21.041(b)(8)].
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2019.
