55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility requirements for receiving
88 distributions from the national research university fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 62.145(a), Education Code, is amended to
1111 read as follows:
1212 (a) A general academic teaching institution becomes
1313 eligible to receive an initial distribution of money appropriated
1414 under this subchapter for a state fiscal year if:
1515 (1) the institution is designated as an emerging
1616 research university under the coordinating board's accountability
1717 system;
1818 (2) in each of the two state fiscal years preceding the
1919 state fiscal year for which the appropriation is made, the
2020 institution expended at least $45 million in restricted research
2121 funds; and
2222 (3) the institution:
2323 (A) satisfies at least four of the following
2424 criteria:
2525 (i) [(A)] the value of the institution's
2626 endowment funds is at least $400 million in each of the two state
2727 fiscal years preceding the state fiscal year for which the
2828 appropriation is made;
2929 (ii) [(B)] the institution awarded at least
3030 200 doctor of philosophy degrees during each of the two academic
3131 years preceding the state fiscal year for which the appropriation
3232 is made;
3333 (iii) [(C)] the entering freshman class of
3434 the institution for each of those two academic years demonstrated
3535 high academic achievement, as determined according to standards
3636 prescribed by the coordinating board by rule, giving consideration
3737 to the future educational needs of the state as articulated in the
3838 coordinating board's "Closing the Gaps" report;
3939 (iv) [(D)] the institution is designated as
4040 a member of the Association of Research Libraries or has a Phi Beta
4141 Kappa chapter or has received an equivalent recognition of research
4242 capabilities and scholarly attainment as determined according to
4343 standards prescribed by the coordinating board by rule;
4444 (v) [(E)] the faculty of the institution
4545 for each of those two academic years was of high quality, as
4646 determined according to coordinating board standards based on the
4747 professional achievement and recognition of the institution's
4848 faculty, including the election of faculty members to national
4949 academies; and
5050 (vi) [(F)] for each of those two academic
5151 years, the institution has demonstrated a commitment to
5252 high-quality graduate education, as determined according to
5353 standards prescribed by the coordinating board by rule, including
5454 standards relating to the number of graduate-level programs at the
5555 institution, the institution's admission standards for graduate
5656 programs, and the level of institutional support for graduate
5757 students; or
5858 (B) satisfies at least one of the criteria listed
5959 in Paragraph (A) and is classified as an R1 doctorate-granting
6060 university, or an equivalent designation if those classifications
6161 are revised, under the Carnegie Classification of Institutions of
6262 Higher Education.
6363 SECTION 2. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2019.
