410 AN ACT
511 relating to continuing education training on civil process for
612 constables.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 1701.3545, Occupations Code, is amended
915 by amending Subsections (a), (b), and (f) and adding Subsection
1016 (b-1) to read as follows:
1117 (a) A public institution of higher education selected by the
1218 commission shall establish and offer a program of initial training
1319 and a program of continuing education for constables. The
1420 curriculum for each program must relate to law enforcement
1521 management [and civil process issues]. The institution selected
1622 under this subsection shall develop the curriculum for the
1723 programs. The curriculum must be approved by the commission.
1824 (b) Each constable must complete at least 40 hours of
1925 continuing education provided by the selected institution under
2026 Subsection (a) [this section] each 48-month period. The commission
2127 by rule shall establish a uniform 48-month continuing education
2228 training period.
2329 (b-1) In addition to the requirements of Subsection (b),
2430 during each 48-month continuing education training period each
2531 constable must complete at least 20 hours of continuing education
2632 instruction on civil process to be provided by a public institution
2733 of higher education selected by the commission under this
2834 subsection. The commission shall establish minimum curriculum
2935 requirements for the continuing education course on civil process
3036 required by this subsection. The commission may waive the
3137 continuing education requirements of this subsection if:
3238 (1) a constable requests a waiver because of hardship;
3339 and
3440 (2) the commission determines that a hardship exists.
3541 (f) An individual who is subject to the continuing education
3642 requirements of Subsections [Subsection] (b) and (b-1) is exempt
3743 from other continuing education requirements under this
3844 subchapter.
3945 SECTION 2. This Act takes effect September 1, 2019.
