| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 1701.3545, Occupations Code, is amended |
|---|
| 9 | 15 | | by amending Subsections (a), (b), and (f) and adding Subsection |
|---|
| 10 | 16 | | (b-1) to read as follows: |
|---|
| 11 | 17 | | (a) A public institution of higher education selected by the |
|---|
| 12 | 18 | | commission shall establish and offer a program of initial training |
|---|
| 13 | 19 | | and a program of continuing education for constables. The |
|---|
| 14 | 20 | | curriculum for each program must relate to law enforcement |
|---|
| 15 | 21 | | management [and civil process issues]. The institution selected |
|---|
| 16 | 22 | | under this subsection shall develop the curriculum for the |
|---|
| 17 | 23 | | programs. The curriculum must be approved by the commission. |
|---|
| 18 | 24 | | (b) Each constable must complete at least 40 hours of |
|---|
| 19 | 25 | | continuing education provided by the selected institution under |
|---|
| 20 | 26 | | Subsection (a) [this section] each 48-month period. The commission |
|---|
| 21 | 27 | | by rule shall establish a uniform 48-month continuing education |
|---|
| 22 | 28 | | training period. |
|---|
| 23 | 29 | | (b-1) In addition to the requirements of Subsection (b), |
|---|
| 24 | 30 | | during each 48-month continuing education training period each |
|---|
| 25 | 31 | | constable must complete at least 20 hours of continuing education |
|---|
| 26 | 32 | | instruction on civil process to be provided by a public institution |
|---|
| 27 | 33 | | of higher education selected by the commission under this |
|---|
| 28 | 34 | | subsection. The commission shall establish minimum curriculum |
|---|
| 29 | 35 | | requirements for the continuing education course on civil process |
|---|
| 30 | 36 | | required by this subsection. The commission may waive the |
|---|
| 31 | 37 | | continuing education requirements of this subsection if: |
|---|
| 32 | 38 | | (1) a constable requests a waiver because of hardship; |
|---|
| 33 | 39 | | and |
|---|
| 34 | 40 | | (2) the commission determines that a hardship exists. |
|---|
| 35 | 41 | | (f) An individual who is subject to the continuing education |
|---|
| 36 | 42 | | requirements of Subsections [Subsection] (b) and (b-1) is exempt |
|---|
| 37 | 43 | | from other continuing education requirements under this |
|---|
| 38 | 44 | | subchapter. |

| 39 | 45 | | SECTION 2. This Act takes effect September 1, 2019. |
