119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Subchapter B, Chapter 44, Education Code, is
1311 amended by adding Section 44.035 to read as follows:
1412 Sec. 44.035. ADOPTION OF UNIFORM GENERAL CONDITIONS FOR
1513 SCHOOL DISTRICT BUILDING CONSTRUCTION CONTRACTS. (a) After
1614 reviewing the uniform general conditions adopted by the Texas
1715 Facilities Commission under Section 2166.302, Government Code, the

2927 SECTION 2. Not later than the 180th day after the effective
3028 date of this Act, the Texas Education Agency by rule shall adopt the
3129 initial uniform general conditions applicable to building
3230 construction contracts made by school districts as provided by
3331 Section 44.035(a), Education Code, as added by this Act.
3432 SECTION 3. This Act takes effect immediately if it receives
3533 a vote of two-thirds of all the members elected to each house, as
3634 provided by Section 39, Article III, Texas Constitution. If this
3735 Act does not receive the vote necessary for immediate effect, this
3836 Act takes effect September 1, 2019.
