| 12 | 10 | | SECTION 1. Subchapter B, Chapter 44, Education Code, is |

| 13 | 11 | | amended by adding Section 44.035 to read as follows: |

| 14 | 12 | | Sec. 44.035. ADOPTION OF UNIFORM GENERAL CONDITIONS FOR |

| 15 | 13 | | SCHOOL DISTRICT BUILDING CONSTRUCTION CONTRACTS. (a) After |
|---|
| 16 | 14 | | reviewing the uniform general conditions adopted by the Texas |
|---|
| 17 | 15 | | Facilities Commission under Section 2166.302, Government Code, the |
|---|
| 19 | 17 | | incorporated in all building construction contracts made by school |
|---|
| 20 | 18 | | districts. |
|---|
| 21 | 19 | | (b) Not later than the 180th day after the date the Texas |
|---|
| 22 | 20 | | Facilities Commission adopts additional uniform general conditions |
|---|
| 23 | 21 | | or amends the uniform general conditions adopted under Section |
|---|
| 24 | 22 | | 2166.302, Government Code, the agency shall review those additions |
|---|
| 25 | 23 | | or amendments and the agency's uniform general conditions for |
|---|
| 26 | 24 | | school district building construction contracts and modify the |
|---|
| 27 | 25 | | conditions for school district building construction contracts as |
|---|
| 28 | 26 | | the agency considers appropriate. |
|---|
| 29 | 27 | | SECTION 2. Not later than the 180th day after the effective |
|---|
| 30 | 28 | | date of this Act, the Texas Education Agency by rule shall adopt the |
|---|
| 31 | 29 | | initial uniform general conditions applicable to building |
|---|
| 32 | 30 | | construction contracts made by school districts as provided by |
|---|
| 33 | 31 | | Section 44.035(a), Education Code, as added by this Act. |
|---|
| 34 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 36 | | Act takes effect September 1, 2019. |
