4	10		AN ACT
5	11		relating to disease prevention and preparedness information for
6	12		emergency medical services personnel on certification or
7	13		recertification.
8	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	15		SECTION 1. Subchapter C, Chapter 773, Health and Safety
10	16		Code, is amended by adding Section 773.0551 to read as follows:
11	17		Sec. 773.0551. DISEASE PREVENTION AND PREPAREDNESS
12	18		INFORMATION ON CERTIFICATION OF EMERGENCY MEDICAL SERVICES
13	19		PERSONNEL. (a) In this section:
14	20		(1) "Applicant" means an individual who files an
15	21		application for certification or recertification as emergency
16	22		medical services personnel under Section 773.055.
17	23		(2) "Immunization registry" means the immunization
18	24		registry established under Section 161.007.
19	25		(b) The executive commissioner by rule shall adopt a system
20	26		under which the Health and Human Services Commission provides an
21	27		applicant immunization information. The system must require the
22	28		commission to provide:
23	29		(1) if the applicant's immunization history is
24	30		included in the immunization registry, written notice of the
25	31		applicant's immunization history, using information from the
26	32		immunization registry; or
27	33		(2) if the applicant's immunization history is not
28	34		included in the immunization registry, the following information:
29	35		(A) details about the program developed under
30	36		Section 161.00707; and
31	37		(B) the specific risks to emergency medical
32	38		services personnel when responding rapidly to an emergency of
33	39		exposure to and infection by a potentially serious or deadly
34	40		communicable disease that an immunization may prevent.
35	41		SECTION 2. As soon as practicable after the effective date
36	42		of this Act, the executive commissioner of the Health and Human
37	43		Services Commission shall adopt rules necessary to implement
38	44		Section 773.0551, Health and Safety Code, as added by this Act.
39	45		SECTION 3. This Act takes effect immediately if it receives
40	46		a vote of two-thirds of all the members elected to each house, as
41	47		provided by Section 39, Article III, Texas Constitution. If this
42	48		Act does not receive the vote necessary for immediate effect, this
43	49		Act takes effect September 1, 2019.
