410 AN ACT
511 relating to disease prevention and preparedness information for
612 emergency medical services personnel on certification or
713 recertification.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Subchapter C, Chapter 773, Health and Safety
1016 Code, is amended by adding Section 773.0551 to read as follows:
1117 Sec. 773.0551. DISEASE PREVENTION AND PREPAREDNESS
1218 INFORMATION ON CERTIFICATION OF EMERGENCY MEDICAL SERVICES
1319 PERSONNEL. (a) In this section:
1420 (1) "Applicant" means an individual who files an
1521 application for certification or recertification as emergency
1622 medical services personnel under Section 773.055.
1723 (2) "Immunization registry" means the immunization
1824 registry established under Section 161.007.
1925 (b) The executive commissioner by rule shall adopt a system
2026 under which the Health and Human Services Commission provides an
2127 applicant immunization information. The system must require the
2228 commission to provide:
2329 (1) if the applicant's immunization history is
2430 included in the immunization registry, written notice of the
2531 applicant's immunization history, using information from the
2632 immunization registry; or
2733 (2) if the applicant's immunization history is not
2834 included in the immunization registry, the following information:
2935 (A) details about the program developed under
3036 Section 161.00707; and
3137 (B) the specific risks to emergency medical
3238 services personnel when responding rapidly to an emergency of
3339 exposure to and infection by a potentially serious or deadly
3440 communicable disease that an immunization may prevent.
3541 SECTION 2. As soon as practicable after the effective date
3642 of this Act, the executive commissioner of the Health and Human
3743 Services Commission shall adopt rules necessary to implement
3844 Section 773.0551, Health and Safety Code, as added by this Act.
3945 SECTION 3. This Act takes effect immediately if it receives
4046 a vote of two-thirds of all the members elected to each house, as
4147 provided by Section 39, Article III, Texas Constitution. If this
4248 Act does not receive the vote necessary for immediate effect, this
4349 Act takes effect September 1, 2019.
