13 | 10 | SECTION 1. Subchapter H, Chapter 418, Government Code, is | |
14 | 11 | amended by adding Section 418.194 to read as follows: | |
15 | 12 | Sec. 418.194. MOBILE INTERNET SERVICE IN AREA SUBJECT TO | |
16 | 13 | DISASTER DECLARATION. (a) In this section, "mobile Internet | |
17 | 14 | service provider" means a person who provides mobile Internet | |
18 | 15 | service to a wireless communication device as defined by Section | |
19 | 16 | 545.425, Transportation Code. | |
20 | 17 | (b) A mobile Internet service provider may not impair or | |
21 | 18 | degrade lawful mobile Internet service access in an area subject to | |
22 | 19 | a declared state of disaster under Section 418.014. | |
23 | - | (c) This section does not prohibit a mobile Internet service | |
24 | - | provider from prioritizing first responder Internet service access | |
25 | - | or a network service designated for use by emergency services | |
26 | - | personnel if there is network congestion in an area subject to a | |
27 | - | declared state of disaster under Section 418.014. | |
28 | 20 | SECTION 2. This Act takes effect September 1, 2019. |
