77 relating to patient medical records regarding maternal death.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter J, Chapter 1001, Health and Safety
1010 Code, is amended by adding Section 1001.242 to read as follows:
1111 Sec. 1001.242. REQUEST FOR MEDICAL RECORDS RELATED TO
1212 MATERNAL DEATH; REPORT. (a) Not later than the 30th business day
1313 after receiving a request from the department, a hospital, birthing
1414 center, or other custodian of a patient's medical records shall
1515 submit to the department the medical records of a patient who was
1616 pregnant at the time of death or was pregnant at any time in the year
1717 preceding the patient's death.
1818 (b) Any personally identifying information in a patient's
1919 medical records acquired by the department under this section is
2020 confidential and is not subject to disclosure under Chapter 552,
2121 Government Code.
2222 (c) The department shall annually prepare and submit to the
2323 legislature a written report that includes:
2424 (1) the average length of time for a hospital,
2525 birthing center, or other custodian of a patient's medical records
2626 to submit to the department the medical records requested under
2727 Subsection (a); and
2828 (2) as applicable, the name and address of any
2929 hospital, birthing center, or other custodian of a patient's
3030 medical records who fails to comply with Subsection (a).
3131 SECTION 2. This Act takes effect September 1, 2019.
