| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter J, Chapter 1001, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Section 1001.242 to read as follows: |
|---|
| 11 | 11 | | Sec. 1001.242. REQUEST FOR MEDICAL RECORDS RELATED TO |
|---|
| 12 | 12 | | MATERNAL DEATH; REPORT. (a) Not later than the 30th business day |
|---|
| 13 | 13 | | after receiving a request from the department, a hospital, birthing |
|---|
| 14 | 14 | | center, or other custodian of a patient's medical records shall |
|---|
| 15 | 15 | | submit to the department the medical records of a patient who was |
|---|
| 16 | 16 | | pregnant at the time of death or was pregnant at any time in the year |
|---|
| 17 | 17 | | preceding the patient's death. |
|---|
| 18 | 18 | | (b) Any personally identifying information in a patient's |
|---|
| 19 | 19 | | medical records acquired by the department under this section is |
|---|
| 20 | 20 | | confidential and is not subject to disclosure under Chapter 552, |
|---|
| 21 | 21 | | Government Code. |
|---|
| 22 | 22 | | (c) The department shall annually prepare and submit to the |
|---|
| 23 | 23 | | legislature a written report that includes: |
|---|
| 24 | 24 | | (1) the average length of time for a hospital, |
|---|
| 25 | 25 | | birthing center, or other custodian of a patient's medical records |
|---|
| 26 | 26 | | to submit to the department the medical records requested under |
|---|
| 27 | 27 | | Subsection (a); and |
|---|
| 28 | 28 | | (2) as applicable, the name and address of any |
|---|
| 29 | 29 | | hospital, birthing center, or other custodian of a patient's |
|---|
| 30 | 30 | | medical records who fails to comply with Subsection (a). |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2019. |
