7 | 7 | | relating to termination by a managed care organization of a |

8 | 8 | | provider's participation in Medicaid and child health plan program |
---|
9 | 9 | | provider networks. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 533.006, Government Code, is amended by |
---|
12 | 12 | | adding Subsection (c) to read as follows: |
---|
13 | 13 | | (c) A managed care organization may not terminate a health |
---|
14 | 14 | | care provider's participation in the organization's provider |
---|
15 | 15 | | network without cause. |
---|
16 | 16 | | SECTION 2. Section 62.155, Health and Safety Code, is |
---|
17 | 17 | | amended by adding Subsection (e) to read as follows: |
---|
18 | 18 | | (e) A managed care organization or other entity selected as |
---|
19 | 19 | | a health plan provider under the child health plan program may not |
---|
20 | 20 | | terminate a health care provider's participation in the |
---|
21 | 21 | | organization's or entity's provider network without cause. |
---|
22 | 22 | | SECTION 3. The changes in law made by this Act apply to a |
---|
23 | 23 | | contract between a managed care organization or other entity and a |
---|
24 | 24 | | health care provider entered into or renewed on or after the |
---|
25 | 25 | | effective date of this Act. A contract entered into or renewed |
---|
26 | 26 | | before that date is governed by the law in effect on the date the |
---|
27 | 27 | | contract was entered into or renewed, and that law is continued in |
---|
28 | 28 | | effect for that purpose. |
---|
29 | 29 | | SECTION 4. If before implementing any provision of this Act |
---|
30 | 30 | | a state agency determines that a waiver or authorization from a |
---|
31 | 31 | | federal agency is necessary for implementation of that provision, |
---|
32 | 32 | | the agency affected by the provision shall request the waiver or |
---|
33 | 33 | | authorization and may delay implementing that provision until the |
---|
34 | 34 | | waiver or authorization is granted. |
---|
35 | 35 | | SECTION 5. This Act takes effect immediately if it receives |
---|
36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
---|
37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
---|
39 | 39 | | Act takes effect September 1, 2019. |
