55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to termination by a managed care organization of a
88 provider's participation in Medicaid and child health plan program
99 provider networks.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 533.006, Government Code, is amended by
1212 adding Subsection (c) to read as follows:
1313 (c) A managed care organization may not terminate a health
1414 care provider's participation in the organization's provider
1515 network without cause.
1616 SECTION 2. Section 62.155, Health and Safety Code, is
1717 amended by adding Subsection (e) to read as follows:
1818 (e) A managed care organization or other entity selected as
1919 a health plan provider under the child health plan program may not
2020 terminate a health care provider's participation in the
2121 organization's or entity's provider network without cause.
2222 SECTION 3. The changes in law made by this Act apply to a
2323 contract between a managed care organization or other entity and a
2424 health care provider entered into or renewed on or after the
2525 effective date of this Act. A contract entered into or renewed
2626 before that date is governed by the law in effect on the date the
2727 contract was entered into or renewed, and that law is continued in
2828 effect for that purpose.
2929 SECTION 4. If before implementing any provision of this Act
3030 a state agency determines that a waiver or authorization from a
3131 federal agency is necessary for implementation of that provision,
3232 the agency affected by the provision shall request the waiver or
3333 authorization and may delay implementing that provision until the
3434 waiver or authorization is granted.
3535 SECTION 5. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2019.
