| 9 | 17 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 18 | | SECTION 1. Section 361.088, Health and Safety Code, is |
|---|
| 11 | 19 | | amended by adding Subsection (h) to read as follows: |
|---|
| 12 | 20 | | (h) Before a permit for a proposed municipal solid waste |
|---|
| 13 | 21 | | management facility is issued, amended, extended, or renewed, the |
|---|
| 14 | 22 | | commission shall inspect the facility or site used or proposed to be |
|---|
| 15 | 23 | | used to store, process, or dispose of municipal solid waste to |
|---|
| 16 | 24 | | confirm information included in the permit application. The |
|---|
| 17 | 25 | | commission by rule shall prescribe the kinds of information in a |
|---|
| 18 | 26 | | permit application that require confirmation under this |
|---|
| 19 | 27 | | subsection. |
|---|
| 20 | 28 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 21 | 29 | | an application for a permit, license, registration, or other |
|---|
| 22 | 30 | | authorization for a municipal solid waste facility that is filed |
|---|
| 23 | 31 | | with the Texas Commission on Environmental Quality on or after the |
|---|
| 24 | 32 | | effective date of this Act. An application for a permit, license, |
|---|
| 25 | 33 | | registration, or other authorization for a municipal solid waste |
|---|
| 26 | 34 | | facility that is filed before the effective date of this Act is |
|---|
| 27 | 35 | | governed by the law in effect on the date of filing, and that law is |
|---|
| 28 | 36 | | continued in effect for that purpose. |

| 29 | 37 | | SECTION 3. This Act takes effect September 1, 2019. |
