4	10		AN ACT
5	11		relating to the intercollegiate athletics fee at Texas A&M
6	12		University--San Antonio; authorizing a fee.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Subchapter E, Chapter 54, Education Code, is
9	15		amended by adding Section 54.53971 to read as follows:
10	16		Sec. 54.53971. INTERCOLLEGIATE ATHLETICS FEES; TEXAS A&M
11	17		UNIVERSITY--SAN ANTONIO. (a) The board of regents of The Texas A&M
12	18		University System may impose on each student enrolled at Texas A&M
13	19		University--San Antonio an intercollegiate athletics fee in an
14	20		amount not to exceed $10 per semester credit hour for each regular
15	21		semester or summer session unless the amount of the fee is increased
16	22		as provided by Subsection (c).
17	23		(b) The fee may not be imposed unless approved by a majority
18	24		vote of the students of the university who participate in a general
19	25		student election held for that purpose.
20	26		(c) The amount of the fee per semester credit hour may be
21	27		increased from one academic year to the next only if approved by a
22	28		majority vote of the students participating in a general student
23	29		election held for that purpose or, if the amount of the increase
24	30		does not exceed five percent, by a majority vote of the legislative
25	31		body of the student government of the university.
26	32		(d) A student enrolled in more than 12 semester credit hours
27	33		shall pay the fee in an amount equal to the amount imposed on a
28	34		student enrolled in 12 semester credit hours during the same
29	35		semester or session.
30	36		(e) A fee imposed under this section may be used to develop
31	37		and maintain an intercollegiate athletics program at the
32	38		university.
33	39		(f) A fee imposed under this section is in addition to any
34	40		other fee authorized by law and may not be considered in determining
35	41		the amount of student services fees that may be imposed under
36	42		Section 54.503.
37	43		SECTION 2. This Act applies beginning with the 2019 fall
38	44		semester.
39	45		SECTION 3. This Act takes effect immediately if it receives
40	46		a vote of two-thirds of all the members elected to each house, as
41	47		provided by Section 39, Article III, Texas Constitution. If this
42	48		Act does not receive the vote necessary for immediate effect, this
43	49		Act takes effect September 1, 2019.
