410 AN ACT
511 relating to the certification of an area's wet or dry status for the
612 purpose of an alcoholic beverage permit or license.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Sections 11.37(a), (b), and (d), Alcoholic
915 Beverage Code, are amended to read as follows:
1016 (a) Not later than the 30th day after the date a prospective
1117 applicant for a permit issued by the commission requests
1218 certification, the [The] county clerk of the county in which the
1319 request [an application for a permit] is made shall certify whether
1420 the location or address given in the request [application] is in a
1521 wet area and whether the sale of alcoholic beverages for which the
1622 permit is sought is prohibited by any valid order of the
1723 commissioners court.
1824 (b) Not later than the 30th day after the date a prospective
1925 applicant for a permit issued by the commission requests
2026 certification, the [The] city secretary or clerk of the city in
2127 which the request [an application for a permit] is made shall
2228 certify whether the location or address given in the request
2329 [application] is in a wet area and whether the sale of alcoholic
2430 beverages for which the permit is sought is prohibited by charter or
2531 ordinance.
2632 (d) Notwithstanding any other provision of this code, if the
2733 county clerk, city secretary, or city clerk certifies that the
2834 location or address given in the request [application] is not in a
2935 wet area or refuses to issue the certification required by this
3036 section, the prospective applicant is entitled to a hearing before
3137 the county judge to contest the certification or refusal to
3238 certify. The prospective applicant must submit a written request
3339 to the county judge for a hearing under this subsection. The
3440 county judge shall conduct a hearing required by this subsection
3541 not later than the 30th day after the date the county judge receives
3642 the written request.
3743 SECTION 2. Sections 61.37(a), (b), and (d), Alcoholic
3844 Beverage Code, are amended to read as follows:
3945 (a) Not later than the 30th day after the date a prospective
4046 applicant for a license issued by the commission requests
4147 certification, the [The] county clerk of the county in which the
4248 request [an application for a license] is made shall certify
4349 whether the location or address given in the request [application]
4450 is in a wet area and whether the sale of alcoholic beverages for
4551 which the license is sought is prohibited by any valid order of the
4652 commissioners court.
4753 (b) Not later than the 30th day after the date a prospective
4854 applicant for a license issued by the commission requests
4955 certification, the [The] city secretary or clerk of the city in
5056 which the request [an application for a license] is made shall
5157 certify whether the location or address given in the request
5258 [application] is in a wet area and whether the sale of alcoholic
5359 beverages for which the license is sought is prohibited by charter
5460 or ordinance.
5561 (d) Notwithstanding any other provision of this code, if the
5662 county clerk, city secretary, or city clerk certifies that the
5763 location or address given in the request [application] is not in a
5864 wet area or refuses to issue the certification required by this
5965 section, the prospective applicant is entitled to a hearing before
6066 the county judge to contest the certification or refusal to
6167 certify. The prospective applicant must submit a written request
6268 to the county judge for a hearing under this subsection. The county
6369 judge shall conduct a hearing required by this subsection not later
6470 than the 30th day after the date the county judge receives the
6571 written request.
6672 SECTION 3. Sections 11.37 and 61.37, Alcoholic Beverage
6773 Code, as amended by this Act, apply only to an application for a
6874 permit or license received on or after the effective date of this
6975 Act. An application for a permit or license received before the
7076 effective date of this Act is governed by the law in effect
7177 immediately before the effective date of this Act, and that law is
7278 continued in effect for that purpose.
7379 SECTION 4. This Act takes effect September 1, 2019.
