66 AN ACT
77 relating to the creation of a grant program to assist law
88 enforcement agencies with the purchase of opioid antagonists.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 772, Government Code, is
1111 amended by adding Section 772.0078 to read as follows:
1212 Sec. 772.0078. OPIOID ANTAGONIST GRANT PROGRAM. (a) In
1313 this section:
1414 (1) "Criminal justice division" means the criminal
1515 justice division established under Section 772.006.
1616 (2) "Opioid antagonist" and "opioid-related drug
1717 overdose" have the meanings assigned by Section 483.101, Health and
1818 Safety Code.
1919 (b) The criminal justice division shall establish and
2020 administer a grant program to provide financial assistance to a law
2121 enforcement agency in this state that seeks to provide opioid
2222 antagonists to peace officers, evidence technicians, and related
2323 personnel who, in the course of performing their duties, are likely
2424 to come into contact with opioids or encounter persons suffering
2525 from an apparent opioid-related drug overdose.
2626 (c) A law enforcement agency may apply for a grant under
2727 this section only if the agency first adopts a policy addressing the
2828 usage of an opioid antagonist for a person suffering from an
2929 apparent opioid-related drug overdose.
3030 (d) In an application for a grant under this section, the
3131 law enforcement agency shall provide information to the criminal
3232 justice division about the frequency and nature of:
3333 (1) interactions between peace officers and persons
3434 suffering from an apparent opioid-related drug overdose;
3535 (2) calls for assistance based on an apparent
3636 opioid-related drug overdose; and
3737 (3) any exposure of peace officers, evidence
3838 technicians, or related personnel to opioids or suspected opioids
3939 in the course of performing their duties and any reactions by those
4040 persons to those substances.
4141 (e) A law enforcement agency receiving a grant under this
4242 section shall, as soon as practicable after receiving the grant,
4343 provide to the criminal justice division proof of purchase of the
4444 opioid antagonists.
4545 (f) The criminal justice division may use any money
4646 available for purposes of this section.
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2019.
