8 | 8 | | enforcement agencies with the purchase of opioid antagonists. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 772, Government Code, is |
---|
11 | 11 | | amended by adding Section 772.0078 to read as follows: |
---|
12 | 12 | | Sec. 772.0078. OPIOID ANTAGONIST GRANT PROGRAM. (a) In |
---|
13 | 13 | | this section: |
---|
14 | 14 | | (1) "Criminal justice division" means the criminal |
---|
15 | 15 | | justice division established under Section 772.006. |
---|
16 | 16 | | (2) "Opioid antagonist" and "opioid-related drug |
---|
17 | 17 | | overdose" have the meanings assigned by Section 483.101, Health and |
---|
18 | 18 | | Safety Code. |
---|
19 | 19 | | (b) The criminal justice division shall establish and |
---|
20 | 20 | | administer a grant program to provide financial assistance to a law |
---|
21 | 21 | | enforcement agency in this state that seeks to provide opioid |
---|
22 | 22 | | antagonists to peace officers, evidence technicians, and related |
---|
23 | 23 | | personnel who, in the course of performing their duties, are likely |
---|
24 | 24 | | to come into contact with opioids or encounter persons suffering |
---|
25 | 25 | | from an apparent opioid-related drug overdose. |
---|
26 | 26 | | (c) A law enforcement agency may apply for a grant under |
---|
27 | 27 | | this section only if the agency first adopts a policy addressing the |
---|
28 | 28 | | usage of an opioid antagonist for a person suffering from an |
---|
29 | 29 | | apparent opioid-related drug overdose. |
---|
30 | 30 | | (d) In an application for a grant under this section, the |
---|
31 | 31 | | law enforcement agency shall provide information to the criminal |
---|
32 | 32 | | justice division about the frequency and nature of: |
---|
33 | 33 | | (1) interactions between peace officers and persons |
---|
34 | 34 | | suffering from an apparent opioid-related drug overdose; |
---|
35 | 35 | | (2) calls for assistance based on an apparent |
---|
36 | 36 | | opioid-related drug overdose; and |
---|
37 | 37 | | (3) any exposure of peace officers, evidence |
---|
38 | 38 | | technicians, or related personnel to opioids or suspected opioids |
---|
39 | 39 | | in the course of performing their duties and any reactions by those |
---|
40 | 40 | | persons to those substances. |
---|
41 | 41 | | (e) A law enforcement agency receiving a grant under this |
---|
42 | 42 | | section shall, as soon as practicable after receiving the grant, |
---|
43 | 43 | | provide to the criminal justice division proof of purchase of the |
---|
44 | 44 | | opioid antagonists. |
---|
45 | 45 | | (f) The criminal justice division may use any money |
---|
46 | 46 | | available for purposes of this section. |
---|
47 | 47 | | SECTION 2. This Act takes effect immediately if it receives |
---|
48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
---|
49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
---|
51 | 51 | | Act takes effect September 1, 2019. |
