44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the disclosure of certain personal information
77 provided on a driver's license application or in connection with a
88 motor vehicle record.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 521.044(a) and (c), Transportation
1111 Code, are amended to read as follows:
1212 (a) Information provided on a driver's license application
1313 that relates to the applicant's social security number may be used
1414 only by the department or disclosed only to:
1515 (1) the child support enforcement division of the
1616 attorney general's office;
1717 (2) another state entity responsible for enforcing the
1818 payment of child support;
1919 (3) the United States Selective Service System as
2020 provided by Section 521.147; [or]
2121 (4) the unclaimed property division of the
2222 comptroller's office; or
2323 (5) the secretary of state for the purposes of voter
2424 registration or the administration of elections.
2525 (c) On the request of a state entity responsible for
2626 investigating or enforcing the payment of child support or the
2727 secretary of state, the department shall disclose information
2828 regarding an applicant's social security number.
2929 SECTION 2. Section 730.005, Transportation Code, is amended
3030 to read as follows:
3131 Sec. 730.005. REQUIRED DISCLOSURE. Personal information
3232 obtained by an agency in connection with a motor vehicle record
3333 shall be disclosed for use in connection with any matter of:
3434 (1) motor vehicle or motor vehicle operator safety;
3535 (2) motor vehicle theft;
3636 (3) motor vehicle emissions;
3737 (4) motor vehicle product alterations, recalls, or
3838 advisories;
3939 (5) performance monitoring of motor vehicles or motor
4040 vehicle dealers by a motor vehicle manufacturer;
4141 (6) removal of nonowner records from the original
4242 owner records of a motor vehicle manufacturer to carry out the
4343 purposes of:
4444 (A) the Automobile Information Disclosure Act,
4545 15 U.S.C. Section 1231 et seq.;
4646 (B) 49 U.S.C. Chapters 301, 305, 323, 325, 327,
4747 329, and 331;
4848 (C) the Anti Car Theft Act of 1992, 18 U.S.C.
4949 Sections 553, 981, 982, 2119, 2312, 2313, and 2322, 19 U.S.C.
5050 Sections 1646b and 1646c, and 42 U.S.C. Section 3750a et seq., all
5151 as amended;
5252 (D) the Clean Air Act, 42 U.S.C. Section 7401 et
5353 seq., as amended; and
5454 (E) any other statute or regulation enacted or
5555 adopted under or in relation to a law included in Paragraphs
5656 (A)-(D);
5757 (7) child support enforcement under Chapter 231,
5858 Family Code; [or]
5959 (8) enforcement by the Texas Workforce Commission
6060 under Title 4, Labor Code; or
6161 (9) voter registration or the administration of
6262 elections by the secretary of state.
6363 SECTION 3. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2019.
