66 AN ACT
77 relating to peace officers commissioned by the Texas Commission on
88 Law Enforcement for disaster response.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 1701, Occupations Code, is
1111 amended by adding Section 1701.1601 to read as follows:
1212 Sec. 1701.1601. AUTHORITY TO COMMISSION OFFICERS FOR
1313 DISASTER RESPONSE. (a) In this section:
1414 (1) "Disaster" has the meaning assigned by Section
1515 418.004, Government Code.
1616 (2) "State active duty" and "Texas State Guard" have
1717 the meanings assigned by Section 437.001, Government Code.
1818 (b) Subject to Subsection (c), the commission may
1919 commission as a peace officer an individual who is:
2020 (1) a peace officer elected, employed, or appointed by
2121 a political subdivision of this state at the time the individual is
2222 commissioned under this section; and
2323 (2) called to state active duty as a member of the
2424 Texas State Guard for the purpose of responding to a disaster.
2525 (c) A commission under this section expires on the earlier
2626 of:
2727 (1) the date the individual's state active duty ends;
2828 or
2929 (2) the date responding to a disaster ceases to be the
3030 primary purpose for the state active duty.
3131 (d) The commission is not required to comply with Section
3232 1701.303 with respect to a peace officer commissioned under this
3333 section.
3434 SECTION 2. Article 2.12, Code of Criminal Procedure, is
3535 amended to read as follows:
3636 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
3737 officers:
3838 (1) sheriffs, their deputies, and those reserve
3939 deputies who hold a permanent peace officer license issued under
4040 Chapter 1701, Occupations Code;
4141 (2) constables, deputy constables, and those reserve
4242 deputy constables who hold a permanent peace officer license issued
4343 under Chapter 1701, Occupations Code;
4444 (3) marshals or police officers of an incorporated
4545 city, town, or village, and those reserve municipal police officers
4646 who hold a permanent peace officer license issued under Chapter
4747 1701, Occupations Code;
4848 (4) rangers, officers, and members of the reserve
4949 officer corps commissioned by the Public Safety Commission and the
5050 Director of the Department of Public Safety;
5151 (5) investigators of the district attorneys', criminal
5252 district attorneys', and county attorneys' offices;
5353 (6) law enforcement agents of the Texas Alcoholic
5454 Beverage Commission;
5555 (7) each member of an arson investigating unit
5656 commissioned by a city, a county, or the state;
5757 (8) officers commissioned under Section 37.081,
5858 Education Code, or Subchapter E, Chapter 51, Education Code;
5959 (9) officers commissioned by the General Services
6060 Commission;
6161 (10) law enforcement officers commissioned by the
6262 Parks and Wildlife Commission;
6363 (11) airport police officers commissioned by a city
6464 with a population of more than 1.18 million located primarily in a
6565 county with a population of 2 million or more that operates an
6666 airport that serves commercial air carriers;
6767 (12) airport security personnel commissioned as peace
6868 officers by the governing body of any political subdivision of this
6969 state, other than a city described by Subdivision (11), that
7070 operates an airport that serves commercial air carriers;
7171 (13) municipal park and recreational patrolmen and
7272 security officers;
7373 (14) security officers and investigators commissioned
7474 as peace officers by the comptroller;
7575 (15) officers commissioned by a water control and
7676 improvement district under Section 49.216, Water Code;
7777 (16) officers commissioned by a board of trustees
7878 under Chapter 54, Transportation Code;
7979 (17) investigators commissioned by the Texas Medical
8080 Board;
8181 (18) officers commissioned by:
8282 (A) the board of managers of the Dallas County
8383 Hospital District, the Tarrant County Hospital District, the Bexar
8484 County Hospital District, or the El Paso County Hospital District
8585 under Section 281.057, Health and Safety Code;
8686 (B) the board of directors of the Ector County
8787 Hospital District under Section 1024.117, Special District Local
8888 Laws Code; and
8989 (C) the board of directors of the Midland County
9090 Hospital District of Midland County, Texas, under Section 1061.121,
9191 Special District Local Laws Code;
9292 (19) county park rangers commissioned under
9393 Subchapter E, Chapter 351, Local Government Code;
9494 (20) investigators employed by the Texas Racing
9595 Commission;
9696 (21) officers commissioned under Chapter 554,
9797 Occupations Code;
9898 (22) officers commissioned by the governing body of a
9999 metropolitan rapid transit authority under Section 451.108,
100100 Transportation Code, or by a regional transportation authority
101101 under Section 452.110, Transportation Code;
102102 (23) investigators commissioned by the attorney
103103 general under Section 402.009, Government Code;
104104 (24) security officers and investigators commissioned
105105 as peace officers under Chapter 466, Government Code;
106106 (25) officers appointed by an appellate court under
107107 Subchapter F, Chapter 53, Government Code;
108108 (26) officers commissioned by the state fire marshal
109109 under Chapter 417, Government Code;
110110 (27) an investigator commissioned by the commissioner
111111 of insurance under Section 701.104, Insurance Code;
112112 (28) apprehension specialists and inspectors general
113113 commissioned by the Texas Juvenile Justice Department as officers
114114 under Sections 242.102 and 243.052, Human Resources Code;
115115 (29) officers appointed by the inspector general of
116116 the Texas Department of Criminal Justice under Section 493.019,
117117 Government Code;
118118 (30) investigators or officers commissioned by the
119119 Texas Commission on Law Enforcement under Section 1701.160 or
120120 1701.1601, as applicable, Occupations Code;
121121 (31) commission investigators commissioned by the
122122 Texas Private Security Board under Section 1702.061, Occupations
123123 Code;
124124 (32) the fire marshal and any officers, inspectors, or
125125 investigators commissioned by an emergency services district under
126126 Chapter 775, Health and Safety Code;
127127 (33) officers commissioned by the State Board of
128128 Dental Examiners under Section 254.013, Occupations Code, subject
129129 to the limitations imposed by that section;
130130 (34) investigators commissioned by the Texas Juvenile
131131 Justice Department as officers under Section 221.011, Human
132132 Resources Code; and
133133 (35) the fire marshal and any related officers,
134134 inspectors, or investigators commissioned by a county under
135135 Subchapter B, Chapter 352, Local Government Code.
136136 SECTION 3. This Act takes effect September 1, 2019.
