56 AN ACT
67 relating to the date on which certain persons placed on deferred
78 adjudication community supervision are eligible to file a petition
89 for an order of nondisclosure of criminal history record
910 information.
1011 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1112 SECTION 1. Section 411.0725(e), Government Code, is amended
1213 to read as follows:
1314 (e) A person may petition the court that placed the person
1415 on deferred adjudication community supervision for an order of
1516 nondisclosure of criminal history record information under this
1617 section only on or after:
1718 (1) the discharge and dismissal, if the offense for
1819 which the person was placed on deferred adjudication was a
1920 misdemeanor other than a misdemeanor described by Subdivision (2);
2021 (2) the first [second] anniversary of the discharge
2122 and dismissal, if the offense for which the person was placed on
2223 deferred adjudication was a misdemeanor under Chapter 20, 21, 22,
23- 25, 42, 43, or 46, Penal Code; [or]
24- (3) the first anniversary of the discharge and
24+ 25, 42, 43, or 46, Penal Code; or
25+ (3) the third [fifth] anniversary of the discharge and
2526 dismissal, if the offense for which the person was placed on
26- deferred adjudication was a state jail felony under Chapter 481,
27- Health and Safety Code, listed in Article 42A.551(a), Code of
28- Criminal Procedure; or
29- (4) t
30- he third [fifth] anniversary of the discharge and
31- dismissal, if the offense for which the person was placed on
32- deferred adjudication was a felony, other than a state jail felony
33- described by Subdivision (3).

3428 SECTION 2. This Act takes effect September 1, 2019.
