411 AN ACT
512 relating to the audit of wholesale invoices during certain audits
613 of pharmacists and pharmacies.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. Subchapter F, Chapter 1369, Insurance Code, is
916 amended by adding Section 1369.2581 to read as follows:
1017 Sec. 1369.2581. AUDIT DISCREPANCIES; WHOLESALE INVOICES.
1118 (a) A health benefit plan issuer or pharmacy benefit manager that
1219 audits wholesale invoices during an audit of a pharmacist or
1320 pharmacy may not audit the pharmacy claims of another health
1421 benefit plan or pharmacy benefit manager.
1522 (b) A health benefit plan issuer or pharmacy benefit manager
1623 shall reverse a finding of a discrepancy if:
1724 (1) the National Drug Code for the dispensed drug is in
1825 a quantity that is a subunit or multiple of the drug purchased by
1926 the pharmacist or pharmacy as supported by a wholesale invoice;
2027 (2) the pharmacist or pharmacy dispensed the correct
2128 quantity of the drug according to the prescription; and
2229 (3) the drug dispensed by the pharmacist or pharmacy
2330 shares all but the last two digits of the National Drug Code of the
2431 drug reflected on the supplier invoice.
2532 (c) A health benefit plan issuer or pharmacy benefit manager
2633 must accept as evidence to support the validity of a pharmacy claim
2734 related to a dispensed drug:
2835 (1) subject to validation, including validation by
2936 pharmacy purchase order and payment of a supplier invoice, copies
3037 of supplier invoices in the pharmacist's or pharmacy's possession,
3138 including:
3239 (A) supplier invoices issued before the date the
3340 drug was dispensed and not earlier than 60 days before the first day
3441 of the audit period; and
3542 (B) invoices and any supporting documents from
3643 any supplier authorized by federal or state law to transfer
3744 ownership of the drug acquired by the pharmacist or pharmacy; and
3845 (2) reports required by any state board or agency.
3946 (d) A health benefit plan issuer or pharmacy benefit manager
4047 must provide, not later than the fifth business day after the date
4148 of a request by the pharmacist or pharmacy, any supporting
4249 documents the pharmacist's or pharmacy's suppliers provided to the
4350 health benefit plan issuer or pharmacy benefit manager.
4451 SECTION 2. The changes in law made by this Act apply only to
4552 an audit conducted under a contract between a pharmacist or
4653 pharmacy and a health benefit plan issuer or pharmacy benefit
4754 manager entered into, amended, or renewed on or after the effective
4855 date of this Act.
4956 SECTION 3. This Act takes effect September 1, 2019.
