55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the appointment of counsel to represent an indigent
88 person in certain criminal proceedings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 26.04, Code of Criminal Procedure, is
1111 amended by adding Subsection (i-1) to read as follows:
1212 (i-1) Notwithstanding Subsection (j)(2) or any other law,
1313 an attorney may be appointed under this article to represent an
1414 indigent person for the sole purpose of providing counsel in
1515 relation to that person's appearance before a magistrate as
1616 required by Article 14.06(a), 15.17(a), or 15.18(a). The attorney
1717 may continue to represent the person following the proceeding if
1818 appointed for that purpose under the other provisions of this
1919 article.
2020 SECTION 2. The change in law made by this Act applies only
2121 to a person who is arrested on or after the effective date of this
2222 Act. A person arrested before the effective date of this Act is
2323 governed by the law in effect on the date the person was arrested,
2424 and the former law is continued in effect for that purpose.
2525 SECTION 3. This Act takes effect September 1, 2019.
