410 AN ACT
511 relating to financing of recreational facilities by the Charterwood
612 Municipal Utility District of Harris County; providing authority to
713 issue bonds.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1016 Code, is amended by adding Chapter 8054 to read as follows:
1117 CHAPTER 8054. CHARTERWOOD MUNICIPAL UTILITY DISTRICT OF HARRIS
1218 COUNTY
1319 SUBCHAPTER A. GENERAL PROVISIONS
1420 Sec. 8054.0101. DEFINITIONS. In this chapter:
1521 (1) "District" means the Charterwood Municipal
1622 Utility District of Harris County.
1723 (2) "Recreational facilities" has the meaning
1824 assigned by Section 49.462, Water Code.
1925 SUBCHAPTER B. BONDS AND OTHER OBLIGATIONS
2026 Sec. 8054.0201. BONDS FOR RECREATIONAL FACILITIES. (a)
2127 The limitation on the outstanding principal amount of bonds, notes,
2228 and other obligations provided by Section 49.4645(a), Water Code,
2329 does not apply to the district.
2430 (b) The outstanding principal amount of bonds, notes, and
2531 other obligations issued to finance recreational facilities
2632 supported by ad valorem taxes may not exceed:
2733 (1) an amount equal to three percent of the value of
2834 the taxable property in the district; or
2935 (2) if supported by contract taxes under Section
3036 49.108, Water Code, an amount equal to three percent of the value of
3137 the taxable property in the districts making payments under the
3238 contract.
3339 (c) The amounts described by Subsection (b) are calculated
3440 based on the tax rolls of the central appraisal districts at the
3541 time of the issuance of the bonds, notes, and other obligations.
3642 SECTION 2. (a) The legal notice of the intention to
3743 introduce this Act, setting forth the general substance of this
3844 Act, has been published as provided by law, and the notice and a
3945 copy of this Act have been furnished to all persons, agencies,
4046 officials, or entities to which they are required to be furnished
4147 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4248 Government Code.
4349 (b) The governor, one of the required recipients, has
4450 submitted the notice and Act to the Texas Commission on
4551 Environmental Quality.
4652 (c) The Texas Commission on Environmental Quality has filed
4753 its recommendations relating to this Act with the governor, the
4854 lieutenant governor, and the speaker of the house of
4955 representatives within the required time.
5056 (d) All requirements of the constitution and laws of this
5157 state and the rules and procedures of the legislature with respect
5258 to the notice, introduction, and passage of this Act are fulfilled
5359 and accomplished.
5460 SECTION 3. This Act takes effect September 1, 2019.
