| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 2153.452, Occupations Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | Sec. 2153.452. ZONING. A [(a) For purposes of zoning, a] | |
| 13 | 13 | political subdivision of this state may adopt zoning regulations to | |
| 14 | 14 | govern [shall treat] the exhibition of a music or skill or pleasure | |
| 15 | 15 | coin-operated machine [in the same manner as the political | |
| 16 | 16 | subdivision treats the principal use of the property where the | |
| 17 | 17 | machine is exhibited]. | |
| 18 | 18 | [(b) Subsection (a) does not prohibit a municipality from | |
| 19 | 19 | restricting the exhibition of a coin-operated amusement machine | |
| 20 | 20 | within 300 feet of a church, school, or hospital.] | |
| 21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
| 22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
| 23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
| 24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
| 25 | 25 | Act takes effect September 1, 2019. |
