4	10		AN ACT
5	11		relating to the terms and election of the members of the board of
6	12		directors of the Elm Creek Watershed Authority.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Section 14, Chapter 273, Acts of the 55th
9	15		Legislature, Regular Session, 1957, is amended to read as follows:
10	16		Sec. 14. (a) The Board of Directors of the Authority is
11	17		composed [shall be comprised] of eight persons who serve staggered,
12	18		four-year terms.
13	19		(b) [Immediately after this Act becomes effective, the
14	20		following named persons shall be the directors of the Authority and
15	21		shall constitute the Board of Directors of said Authority:
16	22		[W. M. Evetts, Route 1, Moody, Texas;
17	23		[David Haggard, Route 4, Oenaville, Texas;
18	24		[J. W. Holmes, Route 2, Rogers, Texas;
19	25		[Buster Griffin, Buckholts, Texas;
20	26		[Jim Reddin, Troy, Texas;
21	27		[Bartle Crenan, Cameron, Texas;
22	28		[Frank Maruna, Temple, Texas; and
23	29		[A. A. Stavinoha, Temple, Texas.
24	30		[The Board of Directors herein appointed shall serve
25	31		until their successors have been duly elected and qualified. The
26	32		first four directors named above shall serve until the second
27	33		Tuesday in January, 1958, and the following four directors shall
28	34		serve until the second Tuesday in January, 1959.] An election for
29	35		directors shall be held on the uniform election date [second
30	36		Tuesday] in November [January] of each odd-numbered year [and as
31	37		herein provided. Four directors shall be elected in each even
32	38		numbered year and four in each odd numbered year].
33	39		(c) The directors of the Authority or of any subordinate
34	40		district shall be landowners within the Authority and reside within
35	41		Bell, Falls, Milam or McLennan Counties, and shall retain such
36	42		status during their tenure in office or vacate such office.
37	43		SECTION 2. (a) A director of the Elm Creek Watershed
38	44		Authority elected in May 2019 shall serve until the director's
39	45		successor has qualified following the directors' election held on
40	46		the uniform election date in November 2023. A director elected on
41	47		the uniform election date in November 2023 serves a four-year term.
42	48		(b) A director of the Elm Creek Watershed Authority elected
43	49		in 2018 shall serve until the director's successor has qualified
44	50		following the directors' election held on the uniform election date
45	51		in November 2021. A director elected to succeed that director
46	52		serves a four-year term.
47	53		(c) This section expires September 1, 2024.
48	54		SECTION 3. (a) The legal notice of the intention to
49	55		introduce this Act, setting forth the general substance of this
50	56		Act, has been published as provided by law, and the notice and a
51	57		copy of this Act have been furnished to all persons, agencies,
52	58		officials, or entities to which they are required to be furnished
53	59		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
54	60		Government Code.
55	61		(b) The governor, one of the required recipients, has
56	62		submitted the notice and Act to the Texas Commission on
57	63		Environmental Quality.
58	64		(c) The Texas Commission on Environmental Quality has filed
59	65		its recommendations relating to this Act with the governor, the
60	66		lieutenant governor, and the speaker of the house of
61	67		representatives within the required time.
62	68		(d) All requirements of the constitution and laws of this
63	69		state and the rules and procedures of the legislature with respect
64	70		to the notice, introduction, and passage of this Act are fulfilled
65	71		and accomplished.
66	72		SECTION 4. This Act takes effect September 1, 2019.
