55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for the criminal offense of tampering
88 with or fabricating physical evidence.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.09, Penal Code, is amended by
1111 amending Subsections (c) and (c-1) and adding Subsection (c-2) to
1212 read as follows:
1313 (c) An offense under Subsection (a) or Subsection (d)(1) is
1414 a felony of the third degree, except that the offense is:
1515 (1) a felony of the second degree if [unless] the thing
1616 altered, destroyed, or concealed is a human corpse; and
1717 (2) a Class A misdemeanor if the thing altered,
1818 destroyed, or concealed could be used as evidence in the
1919 investigation only of or an official proceeding related to only an
2020 offense punishable as a misdemeanor[, in which case the offense is a
2121 felony of the second degree].
2222 (c-1) An offense under Subsection (d)(2) is a Class A
2323 misdemeanor.
2424 (c-2) [(c-1)] It is a defense to prosecution under
2525 Subsection (a) or (d)(1) that the record, document, or thing was
2626 visual material prohibited under Section 43.261 that was destroyed
2727 as described by Subsection (f)(3) [(f)(3)(B)] of that section.
2828 SECTION 2. The change in law made by this Act applies only
2929 to an offense committed on or after the effective date of this Act.
3030 An offense committed before the effective date of this Act is
3131 governed by the law in effect on the date the offense was committed,
3232 and the former law is continued in effect for that purpose. For
3333 purposes of this section, an offense was committed before the
3434 effective date of this Act if any element of the offense occurred
3535 before that date.
3636 SECTION 3. This Act takes effect September 1, 2019.
