66 AN ACT
77 relating to authorizing the issuance of revenue bonds to fund
88 capital projects at Sul Ross State University and Sul Ross State
99 University Rio Grande College.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1212 amended by adding Section 55.1794 to read as follows:
1313 Sec. 55.1794. TEXAS STATE UNIVERSITY SYSTEM; ADDITIONAL
1414 BONDS. (a) In addition to the other authority granted by this
1515 subchapter, the board of regents of the Texas State University
1616 System may acquire, purchase, construct, improve, renovate,
1717 enlarge, or equip property and facilities, including roads and
1818 related infrastructure, for projects to be financed through the
1919 issuance of bonds in accordance with this subchapter and in
2020 accordance with a systemwide revenue financing program adopted by
2121 the board for the following institutions, not to exceed the
2222 following aggregate principal amounts for the projects specified,
2323 as follows:
2424 (1) Sul Ross State University, $25,550,000 for
2525 expansion of a fine arts facility; and
2626 (2) Sul Ross State University Rio Grande College, $20
2727 million for construction of an academic building.
2828 (b) The board may pledge irrevocably to the payment of bonds
2929 authorized by this section all or any part of the revenue funds of
3030 an institution, branch, or entity of the Texas State University
3131 System, including student tuition charges. The amount of a pledge
3232 made under this subsection may not be reduced or abrogated while the
3333 bonds for which the pledge is made, or bonds issued to refund those
3434 bonds, are outstanding.
3535 (c) If sufficient funds are not available to the board to
3636 meet its obligations under this section, the board may transfer
3737 funds among institutions, branches, and entities of the Texas State
3838 University System to ensure the most equitable and efficient
3939 allocation of available resources for each institution, branch, or
4040 entity to carry out its duties and purposes.
4141 SECTION 2. This Act does not affect any authority or
4242 restriction regarding the activities that a public institution of
4343 higher education may conduct in connection with a facility financed
4444 by bonds authorized by this Act.
4545 SECTION 3. This Act takes effect September 1, 2019.
