| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Subchapter B, Chapter 2301, Insurance Code, is |
|---|
| 9 | 15 | | amended by adding Section 2301.058 to read as follows: |
|---|
| 10 | 16 | | Sec. 2301.058. PROVISION OF POLICY DOCUMENTS AND RELATED |
|---|
| 11 | 17 | | MATERIALS IN LANGUAGE OTHER THAN ENGLISH. (a) An insurer may |
|---|
| 12 | 18 | | provide a customer a version of a personal automobile or |
|---|
| 13 | 19 | | residential property insurance policy or endorsement, or related |
|---|
| 14 | 20 | | explanatory or advertising material, in a language other than |
|---|
| 15 | 21 | | English. The version of the document must state, in the language of |
|---|
| 16 | 22 | | the version, that the English version of the insurance policy |
|---|
| 17 | 23 | | document controls. |
|---|
| 18 | 24 | | (b) In the case of a dispute or complaint, the English |
|---|
| 19 | 25 | | version of the insurance policy document controls. |
|---|
| 20 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 21 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 30 | | Act takes effect September 1, 2019. |
