4	11		AN ACT
5	12		relating to the supervision by a personal bond office of
6	13		individuals granted an occupational driver's license; providing
7	14		for an administrative fee.
8	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	16		SECTION 1. Section 521.2462, Transportation Code, is
10	17		amended by amending Subsection (a) and adding Subsections (a-1),
11	18		(a-2), and (a-3) to read as follows:
12	19		(a) The court granting an occupational license under this
13	20		subchapter may order the person receiving the license to[:
14	21		[(1)] submit to supervision for the purpose of
15	22		verifying the person's [by the local community supervision and
16	23		corrections department to verify] compliance with the conditions
17	24		specified by the order granting the license, including the
18	25		conditions specified in accordance with Section 521.248.
19	26		(a-1) The court may order the supervision of the person to
20	27		be conducted by:
21	28		(1) the local community supervision and corrections
22	29		department; or
23	30		(2) a personal bond office established under Article
24	31		17.42, Code of Criminal Procedure.
25	32		(a-2) If the court orders the person's supervision to be
26	33		conducted by the local community supervision and corrections
27	34		department, the court shall order the person to[; and
28	35		[(2)] pay a monthly administrative fee under Section
29	36		76.015, Government Code.
30	37		(a-3) If the court orders the person's supervision to be
31	38		conducted by a personal bond office, the office may collect from the
32	39		person a reasonable administrative fee of not less than $25 and not
33	40		more than $60 per month.
34	41		SECTION 2. Section 521.251(d-1), Transportation Code, is
35	42		amended to read as follows:
36	43		(d-1) Notwithstanding Subsections (b), (c), and (d), the
37	44		court may issue an occupational license to a person if the person
38	45		submits proof the person has an ignition interlock device installed
39	46		on each motor vehicle owned or operated by the person. If a person
40	47		issued an occupational license under this subsection fails to
41	48		maintain an installed ignition interlock device on each motor
42	49		vehicle owned or operated by the person, the court shall revoke the
43	50		occupational license under Section 521.252 and reinstate the
44	51		suspension of the person's driver's license. A person granted an
45	52		occupational license under this subsection may not be ordered,
46	53		under Section 521.2462, to submit to the supervision of the local
47	54		community supervision and corrections department or a personal bond
48	55		office established under Article 17.42, Code of Criminal Procedure
49	56		[under Section 521.2462], unless the order is entered by a court of
50	57		record.
51	58		SECTION 3. Section 76.015, Government Code, is amended by
52	59		adding Subsection (a-1) to read as follows:
53	60		(a-1) This section does not apply to an individual ordered
54	61		to pay an administrative fee to a personal bond office under Section
55	62		521.2462(a-3), Transportation Code.
56	63		SECTION 4. The change in law made by this Act to Section
57	64		521.2462, Transportation Code, applies to an order issued under
58	65		that section on or after the effective date of this Act, regardless
59	66		of whether the underlying offense giving rise to the order was
60	67		committed before, on, or after the effective date of this Act.
61	68		SECTION 5. This Act takes effect September 1, 2019.
