411 AN ACT
512 relating to the supervision by a personal bond office of
613 individuals granted an occupational driver's license; providing
714 for an administrative fee.
815 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
916 SECTION 1. Section 521.2462, Transportation Code, is
1017 amended by amending Subsection (a) and adding Subsections (a-1),
1118 (a-2), and (a-3) to read as follows:
1219 (a) The court granting an occupational license under this
1320 subchapter may order the person receiving the license to[:
1421 [(1)] submit to supervision for the purpose of
1522 verifying the person's [by the local community supervision and
1623 corrections department to verify] compliance with the conditions
1724 specified by the order granting the license, including the
1825 conditions specified in accordance with Section 521.248.
1926 (a-1) The court may order the supervision of the person to
2027 be conducted by:
2128 (1) the local community supervision and corrections
2229 department; or
2330 (2) a personal bond office established under Article
2431 17.42, Code of Criminal Procedure.
2532 (a-2) If the court orders the person's supervision to be
2633 conducted by the local community supervision and corrections
2734 department, the court shall order the person to[; and
2835 [(2)] pay a monthly administrative fee under Section
2936 76.015, Government Code.
3037 (a-3) If the court orders the person's supervision to be
3138 conducted by a personal bond office, the office may collect from the
3239 person a reasonable administrative fee of not less than $25 and not
3340 more than $60 per month.
3441 SECTION 2. Section 521.251(d-1), Transportation Code, is
3542 amended to read as follows:
3643 (d-1) Notwithstanding Subsections (b), (c), and (d), the
3744 court may issue an occupational license to a person if the person
3845 submits proof the person has an ignition interlock device installed
3946 on each motor vehicle owned or operated by the person. If a person
4047 issued an occupational license under this subsection fails to
4148 maintain an installed ignition interlock device on each motor
4249 vehicle owned or operated by the person, the court shall revoke the
4350 occupational license under Section 521.252 and reinstate the
4451 suspension of the person's driver's license. A person granted an
4552 occupational license under this subsection may not be ordered,
4653 under Section 521.2462, to submit to the supervision of the local
4754 community supervision and corrections department or a personal bond
4855 office established under Article 17.42, Code of Criminal Procedure
4956 [under Section 521.2462], unless the order is entered by a court of
5057 record.
5158 SECTION 3. Section 76.015, Government Code, is amended by
5259 adding Subsection (a-1) to read as follows:
5360 (a-1) This section does not apply to an individual ordered
5461 to pay an administrative fee to a personal bond office under Section
5562 521.2462(a-3), Transportation Code.
5663 SECTION 4. The change in law made by this Act to Section
5764 521.2462, Transportation Code, applies to an order issued under
5865 that section on or after the effective date of this Act, regardless
5966 of whether the underlying offense giving rise to the order was
6067 committed before, on, or after the effective date of this Act.
6168 SECTION 5. This Act takes effect September 1, 2019.
