85 AN ACT
9- relating to the definition of economically disadvantaged person for
10- the purposes of determining whether a business is a historically
11- underutilized business.
6+ relating to the consideration of ownership interests of certain
7+ persons in determining whether a business is a historically
8+ underutilized business for purposes of state contracting.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 2161.001(3), Government Code, is amended
1411 to read as follows:
1512 (3) "Economically disadvantaged person" means a
1613 person who:
1714 (A) is economically disadvantaged because of the
1815 person's identification as a member of a certain group, including:
1916 (i) Black Americans;
2017 (ii) Hispanic Americans;
2118 (iii) women;
22- (iv) Asian Pacific Americans;
23- (v) Subcontinent Asian Americans;
24- (vi) Native Americans; and
25- (vii) [(vi)] veterans as defined by 38
26- U.S.C. Section 101(2) who have suffered at least a 20 percent
19+ (iv) Asian [Pacific] Americans;
20+ (v) Native Americans; and
21+ (vi) veterans as defined by 38 U.S.C.
22+ Section 101(2) who have suffered at least a 20 percent
2723 service-connected disability as defined by 38 U.S.C. Section
28- 101(16); and
29- (B) has suffered the effects of discriminatory
30- practices or other similar insidious circumstances over which the
31- person has no control.

3225 SECTION 2. This Act takes effect September 1, 2019.
