	9	+	A BILL TO BE ENTITLED
4	10		AN ACT
5	11		relating to the board of directors of the Rayburn Country Municipal
6	12		Utility District.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Sections 7(a) and (e), Chapter 1086, Acts of the
9	15		70th Legislature, Regular Session, 1987, are amended to read as
10	16		follows:
11	17		(a) The district is governed by a board of five [seven]
12	18		directors.
13	19		(e) If any of the directors listed in Subsection (d) of this
14	20		section fails to qualify for office, the remaining directors shall
15	21		appoint someone to fill the vacancy for the unexpired term. If at
16	22		any time the number of qualified directors is less than three [four]
17	23		because of the failure or refusal of one or more directors to
18	24		qualify or serve, because of death or incapacitation, or for any
19	25		other reason, the Commissioners Court of Jasper County shall
20	26		appoint the necessary number of directors to fill all vacancies on
21	27		the board.
22	28		SECTION 2. Section 9, Chapter 1086, Acts of the 70th
23	29		Legislature, Regular Session, 1987, is amended to read as follows:
24	30		Sec. 9. ELECTION OF DIRECTORS. An [Beginning in the second
25	31		year following the confirmation and directors' election, an]
26	32		election shall be held on the uniform election date [third
27	33		Saturday] in May in each even-numbered year [every two years] to
28	34		elect the appropriate number of directors to the board.
29	35		SECTION 3. Section 7(g), Chapter 1086, Acts of the 70th
30	36		Legislature, Regular Session, 1987, is repealed.
31	37		SECTION 4. (a) Except as provided by Subsection (b), the
32	38		changes in law made by this Act do not affect the entitlement of a
33	39		member serving on the board of directors of the Rayburn Country
34	40		Municipal Utility District immediately before the effective date of
35	41		this Act to continue to serve as a member of the board for the
36	42		remainder of the member's term.
37	43		(b) On the effective date of this Act, positions 6 and 7, as
38	44		designated by the district, are abolished.
39	45		SECTION 5. (a) The legal notice of the intention to
40	46		introduce this Act, setting forth the general substance of this
41	47		Act, has been published as provided by law, and the notice and a
42	48		copy of this Act have been furnished to all persons, agencies,
43	49		officials, or entities to which they are required to be furnished
44	50		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
45	51		Government Code.
46	52		(b) The governor, one of the required recipients, has
47	53		submitted the notice and Act to the Texas Commission on
48	54		Environmental Quality.
49	55		(c) The Texas Commission on Environmental Quality has filed
50	56		its recommendations relating to this Act with the governor, the
51	57		lieutenant governor, and the speaker of the house of
52	58		representatives within the required time.
53	59		(d) All requirements of the constitution and laws of this
54	60		state and the rules and procedures of the legislature with respect
55	61		to the notice, introduction, and passage of this Act are fulfilled
56	62		and accomplished.
57	63		SECTION 6. This Act takes effect September 1, 2019.
