66 AN ACT
77 relating to sexual harassment prevention training and information
88 for employees.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 21, Labor Code, is amended
1111 by adding Section 21.013 to read as follows:
1212 Sec. 21.013. SEXUAL HARASSMENT PREVENTION TRAINING AND
1313 INFORMATION. (a) In this section, the term "supervisor" includes a
1414 person with the authority to direct an employee's daily activities
1515 while at work, regardless of whether the person has the authority to
1616 hire, fire, or take other tangible employment action with respect
1717 to the employee.
1818 (b) At least once every two years, an employer other than a
1919 state agency shall provide to each employee of the employer at
2020 least:
2121 (1) two hours of sexual harassment prevention
2222 training, if the employee is a supervisor; and
2323 (2) one hour of sexual harassment prevention training,
2424 if the employee is not a supervisor.
2525 (c) The commission shall develop or obtain, and make
2626 available on its Internet website, one-hour and two-hour sexual
2727 harassment prevention training videos that may be used by employers
2828 to provide the training required by this section.
2929 (d) The commission shall develop and make available on its
3030 Internet website for use by employers informational posters and
3131 fact sheets displaying information regarding the prevention of
3232 sexual harassment.
3333 (e) The commission may adopt rules as necessary for the
3434 administration of this section.
3535 SECTION 2. Not later than December 1, 2019, the Texas
3636 Workforce Commission shall post on its Internet website the videos,
3737 posters, and fact sheets required by Section 21.013, Labor Code, as
3838 added by this Act.
3939 SECTION 3. This Act takes effect September 1, 2019.
