55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to establishing the Mental Health Crisis and Suicide
88 Prevention Task Force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Commission" means the Health and Human Services
1212 Commission.
1313 (2) "Executive commissioner" means the executive
1414 commissioner of the Health and Human Services Commission.
1515 (3) "N-1-1 dial code" means a three-digit telephone
1616 number that connects users to a public safety answering point
1717 through dialing the three-digit telephone number.
1818 (4) "Statewide mental health crisis line" means a
1919 telephonic or other electronic system operated 24 hours a day to
2020 connect a mental or behavioral health professional with persons
2121 experiencing a mental health crisis.
2222 (5) "Task force" means the Mental Health Crisis and
2323 Suicide Prevention Task Force.
2424 SECTION 2. ESTABLISHMENT OF TASK FORCE. The Mental Health
2525 Crisis and Suicide Prevention Task Force is established by the
2626 executive commissioner to study the efficacy and feasibility of
2727 creating a statewide mental health crisis line for treating mental
2828 health crises and preventing suicide.
2929 SECTION 3. COMPOSITION OF TASK FORCE. The task force is
3030 composed of:
3131 (1) the governor's designee;
3232 (2) two members of the senate, appointed by the
3333 lieutenant governor;
3434 (3) two members of the house of representatives,
3535 appointed by the speaker of the house; and
3636 (4) 10 members appointed by the executive commissioner
3737 as follows:
3838 (A) two representatives from the Commission on
3939 State Emergency Communications;
4040 (B) two representatives from the commission's
4141 mental health crisis services office;
4242 (C) two mental or behavioral health clinicians
4343 licensed to practice in this state;
4444 (D) two physicians licensed to practice in this
4545 state, one of whom specializes in psychiatry;
4646 (E) one social worker; and
4747 (F) one community advocate in a relevant field.
4848 SECTION 4. CHAIR AND VICE CHAIR. The executive
4949 commissioner shall appoint from among the task force members a
5050 chair and vice chair.
5151 SECTION 5. MEETINGS; QUORUM. (a) The task force shall meet
5252 at the call of the chair. The chair shall set the agenda for each
5353 meeting.
5454 (b) The action of a majority of a quorum constitutes the
5555 action of the task force.
5656 SECTION 6. COMPENSATION; REIMBURSEMENT. (a) Except as
5757 provided by Subsection (b), a member of the task force may not
5858 receive compensation or reimbursement for service on the task
5959 force.
6060 (b) A task force member who is a legislator engaged in the
6161 business of the task force is entitled to compensation and expenses
6262 as provided by Chapter 660, Government Code.
6363 SECTION 7. STUDY; REPORT. (a) In cooperation with the
6464 commission, the task force shall study:
6565 (1) the efficacy and feasibility of designating an
6666 N-1-1 dial code or another dialing code for use as a statewide
6767 mental health crisis line; and
6868 (2) the advantages and disadvantages of using a
6969 particular statewide N-1-1 dial code or another dialing code for a
7070 statewide mental health crisis line.
7171 (b) Not later than September 1, 2020, the task force shall
7272 prepare and submit to the legislature and the commission a written
7373 report containing the results of the study and a recommendation as
7474 to whether to establish a particular N-1-1 dial code or other
7575 covered dialing code for use as a statewide mental health crisis
7676 line.
7777 (c) If the report submitted under Subsection (b) includes a
7878 recommendation to establish a particular N-1-1 dial code or other
7979 covered dialing code for use as a statewide mental health crisis
8080 line, the report must also include:
8181 (1) an outline of the logistics of designating that
8282 dial code;
8383 (2) an estimate of the costs associated with
8484 designating that dial code, including costs incurred by:
8585 (A) service providers, including:
8686 (i) translation changes in the network; and
8787 (ii) cell site analysis and reprogramming
8888 by wireless carriers; and
8989 (B) the state and political subdivisions;
9090 (3) recommendations for designating the dial code;
9191 (4) a cost-benefit analysis comparing the recommended
9292 dial code with the National Suicide Prevention Lifeline, as the
9393 lifeline exists on the date the report is submitted; and
9494 (5) other recommendations as appropriate for
9595 improving the National Suicide Prevention Lifeline generally,
9696 which may include:
9797 (A) increased public education and awareness;
9898 and
9999 (B) improved infrastructure and operations.
100100 SECTION 8. FUNDING. The task force, through the
101101 commission, may accept gifts and grants from any source to fund the
102102 duties of the commission and the task force under this Act.
103103 SECTION 9. APPLICABILITY OF OTHER LAW. Chapter 2110,
104104 Government Code, does not apply to the task force.
105105 SECTION 10. EXPIRATION. This Act expires September 1,
106106 2021.
107107 SECTION 11. EFFECTIVE DATE. This Act takes effect
108108 September 1, 2019.
