66 AN ACT
77 relating to the authority of a school district or open-enrollment
88 charter school to employ or provide chaplains.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 33, Education Code, is
1111 amended by adding Section 33.910 to read as follows:
1212 Sec. 33.910. CHAPLAINS. (a) A school district or
1313 open-enrollment charter school may employ chaplains or provide
1414 volunteer chaplains at district or school campuses to assist:
1515 (1) district or school students, parents, teachers,
1616 staff, and administrators with stress management; or
1717 (2) school counselors or social workers with
1818 performing their assigned duties.
1919 (b) A chaplain who is employed by or serves as a volunteer at
2020 a school district or open-enrollment charter school under this
2121 section is immune from civil liability to the same extent as a
2222 professional employee of a school district under Subchapter B,
2323 Chapter 22.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2019.
