8 | 8 | | charter school to employ or provide chaplains. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter Z, Chapter 33, Education Code, is |
---|
11 | 11 | | amended by adding Section 33.910 to read as follows: |
---|
12 | 12 | | Sec. 33.910. CHAPLAINS. (a) A school district or |
---|
13 | 13 | | open-enrollment charter school may employ chaplains or provide |
---|
14 | 14 | | volunteer chaplains at district or school campuses to assist: |
---|
15 | 15 | | (1) district or school students, parents, teachers, |
---|
16 | 16 | | staff, and administrators with stress management; or |
---|
17 | 17 | | (2) school counselors or social workers with |
---|
18 | 18 | | performing their assigned duties. |
---|
19 | 19 | | (b) A chaplain who is employed by or serves as a volunteer at |
---|
20 | 20 | | a school district or open-enrollment charter school under this |
---|
21 | 21 | | section is immune from civil liability to the same extent as a |
---|
22 | 22 | | professional employee of a school district under Subchapter B, |
---|
23 | 23 | | Chapter 22. |
---|
24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
---|
25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
---|
26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
---|
28 | 28 | | Act takes effect September 1, 2019. |
