| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle A, Title 3, Alcoholic Beverage Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 15A to read as follows: |
|---|
| 12 | 12 | | CHAPTER 15A. DISTILLERY FESTIVAL PERMIT |
|---|
| 13 | 13 | | Sec. 15A.01. AUTHORIZED ACTIVITIES. (a) The holder of a |
|---|
| 14 | 14 | | distillery festival permit may sell distilled spirits at a civic or |
|---|
| 15 | 15 | | alcoholic beverage festival, farmers' market, celebration, or |
|---|
| 16 | 16 | | similar event. |
|---|
| 17 | 17 | | (b) The permit holder may not offer distilled spirits for |
|---|
| 18 | 18 | | sale under this chapter: |
|---|
| 19 | 19 | | (1) for more than five days within a 30-day period; or |
|---|
| 20 | 20 | | (2) on more than three consecutive days at the same |
|---|
| 21 | 21 | | location. |
|---|
| 22 | 22 | | Sec. 15A.02. QUALIFICATION FOR PERMIT. A distillery |
|---|
| 23 | 23 | | festival permit may be issued only to the holder of a distiller's |
|---|
| 24 | 24 | | and rectifier's permit. |
|---|
| 25 | 25 | | Sec. 15A.03. NOTICE OF SALES; PROCEDURES. Before the |
|---|
| 26 | 26 | | holder of a distillery festival permit offers distilled spirits for |
|---|
| 27 | 27 | | sale under this chapter, the permit holder must, in accordance with |
|---|
| 28 | 28 | | any rules adopted or procedures established by the commission, |
|---|
| 29 | 29 | | notify the commission of the date on which and location where the |
|---|
| 30 | 30 | | permit holder will offer distilled spirits for sale under this |
|---|
| 31 | 31 | | chapter. |
|---|
| 32 | 32 | | Sec. 15A.04. PERMIT FEE. The fee for a distillery festival |
|---|
| 33 | 33 | | permit is $50. |
|---|
| 34 | 34 | | Sec. 15A.05. APPLICABILITY OF OTHER LAW. The provisions of |
|---|
| 35 | 35 | | this code applicable to the sale of distilled spirits on the |
|---|
| 36 | 36 | | permitted premises of the holder of a distiller's and rectifier's |
|---|
| 37 | 37 | | permit apply to the sale of distilled spirits under this chapter. |
|---|
| 38 | 38 | | Sec. 15A.06. EFFECT OF VIOLATION ON DISTILLER'S AND |
|---|
| 39 | 39 | | RECTIFIER'S PERMIT. The distiller's and rectifier's permit of the |
|---|
| 40 | 40 | | holder of a distillery festival permit may be canceled or suspended |
|---|
| 41 | 41 | | for a violation occurring in connection with activities conducted |
|---|
| 42 | 42 | | under this chapter. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2019. |
