77 relating to the confidentiality of certain grand juror information.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 19.42, Code of Criminal Procedure, is
1010 amended to read as follows:
1111 Art. 19.42. PERSONAL INFORMATION ABOUT GRAND JURORS. (a)
1212 Except as provided by Subsection (b), information collected by the
1313 court, court personnel, or prosecuting attorney during the grand
1414 jury selection process about a person who serves as a grand juror,
1515 including the person's name, home address, home telephone number,
1616 social security number, driver's license number, and other personal
1717 information, is confidential and may not be disclosed by the court,
1818 court personnel, or prosecuting attorney.
1919 (b) On application by a party to the proceeding, or on
2020 application by a member of the news media acting in that capacity,
2121 to the court for the disclosure of information described by
2222 Subsection (a), the court shall, on a showing of good cause, [the
2323 court shall] permit disclosure of the information to the applicant
2424 [sought to a party to the proceeding].
2525 SECTION 2. Article 19.42, Code of Criminal Procedure, as
2626 amended by this Act, applies to an application for disclosure of
2727 grand juror information that is filed on or after the effective date
2828 of this Act, regardless of whether the applicable grand juror who is
2929 the subject of the information served on a grand jury impaneled
3030 before, on, or after that date.
3131 SECTION 3. This Act takes effect September 1, 2019.
