55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to powdered alcohol.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1.04(4), Alcoholic Beverage Code, is
1010 amended to read as follows:
1111 (4) "Illicit beverage" means:
1212 (A) an alcoholic beverage:
1313 (i) [(A)] manufactured, distributed,
1414 bought, sold, bottled, rectified, blended, treated, fortified,
1515 mixed, processed, warehoused, stored, possessed, imported, or
1616 transported in violation of this code;
1717 (ii) [(B)] on which a tax imposed by the
1818 laws of this state has not been paid and to which the tax stamp, if
1919 required, has not been affixed; or
2020 (iii) [(C)] possessed, kept, stored, owned,
2121 or imported with intent to manufacture, sell, distribute, bottle,
2222 rectify, blend, treat, fortify, mix, process, warehouse, store, or
2323 transport in violation of this code; or
2424 (B) powdered alcohol.
2525 SECTION 2. Section 101.65, Alcoholic Beverage Code, is
2626 amended to read as follows:
2727 Sec. 101.65. BEVERAGES MADE FROM CERTAIN MATERIALS
2828 PROHIBITED. No person may manufacture, import, sell, serve, or
2929 possess for the purpose of sale an alcoholic beverage made from:
3030 (1) any compound made from synthetic materials;
3131 (2) substandard wines;
3232 (3) imitation wines; [or]
3333 (4) must concentrated at any time to more than 80
3434 degrees Balling; or
3535 (5) powdered alcohol, whether alone or reconstituted.
3636 SECTION 3. This Act takes effect September 1, 2019.
