66 AN ACT
77 relating to the provision of recovery community organization
88 services under Medicaid.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.09991 to read as follows:
1212 Sec. 531.09991. RECOVERY COMMUNITY ORGANIZATIONS. (a) In
1313 this section, "recovery community organization" means a nonprofit
1414 organization that mobilizes resources inside and outside of a local
1515 community to increase the prevalence and quality of long-term
1616 recovery for persons with substance use disorder and their family
1717 members and that is wholly or partly governed by persons recovering
1818 from a substance use disorder or their family members.
1919 (b) The executive commissioner, with input from the work
2020 group established under Subsection (c), shall adopt rules to
2121 provide Medicaid reimbursement for services provided by recovery
2222 community organizations, which must include:
2323 (1) rules that establish training requirements for
2424 recovery community organization service providers;
2525 (2) rules that establish certification and
2626 supervision requirements for recovery community organizations;
2727 (3) rules that define the scope of services that
2828 recovery community organizations may provide;
2929 (4) rules that distinguish services provided by
3030 recovery community organizations from other services that a person
3131 must hold a license to provide; and
3232 (5) any other rules necessary to protect the health
3333 and safety of persons receiving services provided by recovery
3434 community organizations.
3535 (c) The executive commissioner shall establish a work group
3636 to provide input for the adoption of rules under Subsection (b).
3737 The work group is composed of at least nine and not more than 13
3838 members with expertise in substance use recovery or recovery
3939 community organizations. The executive commissioner shall ensure
4040 that at least half of the members in the work group are from rural
4141 communities in this state.
4242 (d) The executive commissioner shall appoint one member of
4343 the work group to serve as presiding officer.
4444 (e) The work group is automatically abolished on the
4545 adoption of rules under Subsection (b).
4646 (f) Subsections (c), (d), and (e) and this subsection expire
4747 September 1, 2021.
4848 SECTION 2. Effective January 1, 2021, Section 32.024, Human
4949 Resources Code, is amended by adding Subsection (pp) to read as
5050 follows:
5151 (pp) The commission in its rules and standards governing the
5252 scope of services provided under the medical assistance program
5353 shall include services provided by recovery community
5454 organizations as defined by Section 531.09991, Government Code, to
5555 the extent permitted by federal law.
5656 SECTION 3. Not later than December 31, 2019, the executive
5757 commissioner of the Health and Human Services Commission shall
5858 establish the work group required by Section 531.09991, Government
5959 Code, as added by this Act.
6060 SECTION 4. Not later than December 31, 2020, the executive
6161 commissioner of the Health and Human Services Commission shall
6262 adopt the rules required by Section 531.09991, Government Code, as
6363 added by this Act.
6464 SECTION 5. If before implementing any provision of this Act
6565 a state agency determines that a waiver or authorization from a
6666 federal agency is necessary for implementation of that provision,
6767 the agency affected by the provision shall request the waiver or
6868 authorization and may delay implementing that provision until the
6969 waiver or authorization is granted.
7070 SECTION 6. Except as otherwise provided by this Act, this
7171 Act takes effect September 1, 2019.
