68 AN ACT
79 relating to the provision of state death benefits to certain
810 members of the Texas military forces.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 615.003, Government Code, is amended to
1113 read as follows:
1214 Sec. 615.003. APPLICABILITY. This chapter applies only to
1315 eligible survivors of the following individuals:
1416 (1) an individual:
1517 (A) elected, appointed, or employed as a peace
1618 officer by the state or a political subdivision of the state under
1719 Article 2.12, Code of Criminal Procedure, or other law; or
1820 (B) employed as a peace officer by a private
1921 institution of higher education, including a private junior
2022 college, that is located in this state under Section 51.212,
2123 Education Code;
2224 (2) a paid probation officer appointed by the director
2325 of a community supervision and corrections department who has the
2426 duties set out in Section 76.002 and the qualifications set out in
2527 Section 76.005, or who was appointed in accordance with prior law;
2628 (3) a parole officer employed by the Texas Department
2729 of Criminal Justice who has the duties set out in Section 508.001
2830 and the qualifications set out in Section 508.113 or in prior law;
2931 (4) a paid jailer;
3032 (5) a member of an organized police reserve or
3133 auxiliary unit who regularly assists peace officers in enforcing
3234 criminal laws;
3335 (6) a member of the class of employees of the
3436 correctional institutions division formally designated as
3537 custodial personnel under Section 615.006 by the Texas Board of
3638 Criminal Justice or its predecessor in function;
3739 (7) a jailer or guard of a county jail who is appointed
3840 by the sheriff and who:
3941 (A) performs a security, custodial, or
4042 supervisory function over the admittance, confinement, or
4143 discharge of prisoners; and
4244 (B) is certified by the Texas Commission on Law
4345 Enforcement;
4446 (8) a juvenile correctional employee of the Texas
4547 Juvenile Justice Department;
4648 (9) an employee of the Health and Human Services
4749 Commission [Department of Aging and Disability Services or
4850 Department of State Health Services] who:
4951 (A) works at the commission's [department's]
5052 maximum security unit; or
5153 (B) performs on-site services for the Texas
5254 Department of Criminal Justice;
5355 (10) an individual who is employed by the state or a
5456 political or legal subdivision and is subject to certification by
5557 the Texas Commission on Fire Protection;
5658 (11) an individual employed by the state or a
5759 political or legal subdivision whose principal duties are aircraft
5860 crash and rescue fire fighting;
5961 (12) a member of an organized volunteer fire-fighting
6062 unit that:
6163 (A) renders fire-fighting services without
6264 remuneration; and
6365 (B) conducts a minimum of two drills each month,
6466 each two hours long;
6567 (13) an individual who:
6668 (A) performs emergency medical services or
6769 operates an ambulance;
6870 (B) is employed by a political subdivision of the
6971 state or is an emergency medical services volunteer as defined by
7072 Section 773.003, Health and Safety Code; and
7173 (C) is qualified as an emergency care attendant
7274 or at a higher level of training under Section 773.046, 773.047,
7375 773.048, 773.049, or 773.0495, Health and Safety Code;
7476 (14) an individual who is employed or formally
7577 designated as a chaplain for:
7678 (A) an organized volunteer fire-fighting unit or
7779 other fire department of this state or of a political subdivision of
7880 this state;
7981 (B) a law enforcement agency of this state or of a
8082 political subdivision of this state; or
8183 (C) the Texas Department of Criminal Justice;
8284 (15) an individual who is employed by the state or a
8385 political subdivision of the state and who is considered by the
8486 governmental employer to be a trainee for a position otherwise
8587 described by this section;
8688 (16) an individual who is employed by the Department
8789 of Public Safety and, as certified by the director, is:
8890 (A) deployed into the field in direct support of
8991 a law enforcement operation, including patrol, investigative,
9092 search and rescue, crime scene, on-site communications, or special
9193 operations; and
9294 (B) given a special assignment in direct support
9395 of operations relating to organized crime, criminal interdiction,
9496 border security, counterterrorism, intelligence, traffic
9597 enforcement, emergency management, regulatory services, or special
9698 investigations; [or]
9799 (17) an individual who is employed by the Parks and
98100 Wildlife Department and, as certified by the executive director of
99101 the Parks and Wildlife Department, is:
100102 (A) deployed into the field in direct support of
101103 a law enforcement operation, including patrol, investigative,
102104 search and rescue, crime scene, on-site communications, or special
103105 operations; and
104106 (B) given a special assignment in direct support
105107 of operations relating to organized crime, criminal interdiction,
106108 border security, counterterrorism, intelligence, traffic
107109 enforcement, emergency management, regulatory services, or special
108110 investigations; or
109111 (18) a member of the Texas military forces, as defined
110112 by Section 437.001:
111- (A) who performs a military duty or is on state
112- active duty, as those terms are defined in Section 437.001; and
113+ (A) who is on state active duty, as that term is
114+ defined in Section 437.001; and
113115 (B) whose eligible survivors are not otherwise
114116 eligible under federal law to receive a payment under 10 U.S.C.
115117 Sections 1475 through 1477 in relation to that duty.
116118 SECTION 2. The change in law made by this Act relating to
117119 the death of a member of the Texas military forces applies only in
118120 relation to a death that occurs on or after the effective date of
119121 this Act. Matters regarding eligibility, payment, and benefits
120122 under Chapter 615, Government Code, in relation to a death that
121123 occurs before the effective date of this Act are governed by the law
122124 in effect on the date the death occurs, and the former law is
123125 continued in effect for that purpose.
124126 SECTION 3. This Act takes effect September 1, 2019.
