5 | 11 | | relating to the period of certain driver's license suspensions. |

6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 13 | | SECTION 1. Section 521.293, Transportation Code, is amended |
---|
8 | 14 | | to read as follows: |
---|
9 | 15 | | Sec. 521.293. PERIOD OF SUSPENSION UNDER SECTION 521.292. |
---|
10 | 16 | | If [(a) Except as provided by Subsection (b), if] the person does |
---|
11 | 17 | | not request a hearing, the period of license suspension under |
---|
12 | 18 | | Section 521.292 is 90 days. |
---|
13 | 19 | | [(b) If the department determines that the person engaged in |
---|
14 | 20 | | conduct described by Section 521.292(a)(1), the period of license |
---|
15 | 21 | | suspension is extended for an additional period of the lesser of: |
---|
16 | 22 | | [(1) the term of the original suspension; or |
---|
17 | 23 | | [(2) one year.] |
---|
18 | 24 | | SECTION 2. Section 521.312(b), Transportation Code, is |
---|
19 | 25 | | amended to read as follows: |
---|
20 | 26 | | (b) Except as provided by Subsection (c)[, Section |
---|
21 | 27 | | 521.293(b),] or Subchapter O, the department may not suspend a |
---|
22 | 28 | | license for a period that exceeds one year. |
---|
23 | 29 | | SECTION 3. The change in law made by this Act applies only |
---|
24 | 30 | | to a driver's license suspension based on conduct that occurred on |
---|
25 | 31 | | or after the effective date of this Act. A driver's license |
---|
26 | 32 | | suspension based on conduct that occurred before the effective date |
---|
27 | 33 | | of this Act is governed by the law in effect on the date the conduct |
---|
28 | 34 | | occurred, and the former law is continued in effect for that |
---|
29 | 35 | | purpose. For purposes of this Act, conduct occurred before the |
---|
30 | 36 | | effective date of this Act if any element of the conduct occurred |
---|
31 | 37 | | before that date. |
---|
32 | 38 | | SECTION 4. This Act takes effect September 1, 2019. |
