| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Subchapter I, Chapter 2165, |
|---|
| 11 | 11 | | Government Code, is amended to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER I. DEFERRED MAINTENANCE FUNDING [FUND] |
|---|
| 13 | 13 | | SECTION 2. Subchapter I, Chapter 2165, Government Code, is |
|---|
| 14 | 14 | | amended by adding Section 2165.404 to read as follows: |
|---|
| 15 | 15 | | Sec. 2165.404. JOINT OVERSIGHT COMMITTEE ON GOVERNMENT |
|---|
| 16 | 16 | | FACILITIES. (a) In this section, "committee" means the Joint |
|---|
| 17 | 17 | | Oversight Committee on Government Facilities. |
|---|
| 18 | 18 | | (b) The committee is created to review deferred maintenance |
|---|
| 19 | 19 | | plans and receive implementation updates. |
|---|
| 20 | 20 | | (c) The committee is composed of six members as follows: |
|---|
| 21 | 21 | | (1) three members of the senate appointed by the |
|---|
| 22 | 22 | | lieutenant governor; and |
|---|
| 23 | 23 | | (2) three members of the house of representatives |
|---|
| 24 | 24 | | appointed by the speaker of the house of representatives. |
|---|
| 25 | 25 | | (d) The chair of the committee shall alternate annually |
|---|
| 26 | 26 | | between: |
|---|
| 27 | 27 | | (1) a member of the senate appointed by the lieutenant |
|---|
| 28 | 28 | | governor; and |
|---|
| 29 | 29 | | (2) a member of the house of representatives appointed |
|---|
| 30 | 30 | | by the speaker of the house of representatives. |
|---|
| 31 | 31 | | (e) The lieutenant governor shall appoint the first chair of |
|---|
| 32 | 32 | | the committee. |
|---|
| 33 | 33 | | (f) A vacancy on the committee shall be filled in the same |
|---|
| 34 | 34 | | manner as the original appointment. |
|---|
| 35 | 35 | | (g) The committee biannually shall provide a written report |
|---|
| 36 | 36 | | to the legislature that identifies: |
|---|
| 37 | 37 | | (1) the amount of money expended for deferred |
|---|
| 38 | 38 | | maintenance; |
|---|
| 39 | 39 | | (2) planned deferred maintenance projects; and |
|---|
| 40 | 40 | | (3) the status of ongoing and completed deferred |
|---|
| 41 | 41 | | maintenance projects. |
|---|
| 42 | 42 | | (h) The committee shall: |
|---|
| 43 | 43 | | (1) have the powers and duties of a joint committee |
|---|
| 44 | 44 | | created by proclamation; and |
|---|
| 45 | 45 | | (2) obtain funding in the same manner as a joint |
|---|
| 46 | 46 | | committee created by proclamation. |
|---|
| 47 | 47 | | (i) The rules adopted by the 86th Legislature for the |
|---|
| 48 | 48 | | administration of joint committees created by proclamation apply to |
|---|
| 49 | 49 | | the committee to the extent the rules are consistent with this |
|---|
| 50 | 50 | | section. |
|---|
| 51 | 51 | | (j) The committee is abolished and this section expires on |
|---|
| 52 | 52 | | September 1, 2025. |
|---|
| 53 | 53 | | SECTION 3. (a) If this Act receives the votes necessary for |
|---|
| 54 | 54 | | immediate effect, the lieutenant governor and the speaker of the |
|---|
| 55 | 55 | | house of representatives shall make appointments to the Joint |
|---|
| 56 | 56 | | Oversight Committee on Government Facilities not later than July 1, |
|---|
| 57 | 57 | | 2019. |
|---|
| 58 | 58 | | (b) If this Act does not receive the votes necessary for |
|---|
| 59 | 59 | | immediate effect, the lieutenant governor and the speaker of the |
|---|
| 60 | 60 | | house of representatives shall make appointments to the Joint |
|---|
| 61 | 61 | | Oversight Committee on Government Facilities not later than |
|---|
| 62 | 62 | | September 15, 2019. |
|---|
| 63 | 63 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 64 | 64 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 65 | 65 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 66 | 66 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 67 | 67 | | Act takes effect September 1, 2019. |
