66 AN ACT
77 relating to legislative oversight of deferred maintenance
88 projects.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Subchapter I, Chapter 2165,
1111 Government Code, is amended to read as follows:
1212 SUBCHAPTER I. DEFERRED MAINTENANCE FUNDING [FUND]
1313 SECTION 2. Subchapter I, Chapter 2165, Government Code, is
1414 amended by adding Section 2165.404 to read as follows:
1515 Sec. 2165.404. JOINT OVERSIGHT COMMITTEE ON GOVERNMENT
1616 FACILITIES. (a) In this section, "committee" means the Joint
1717 Oversight Committee on Government Facilities.
1818 (b) The committee is created to review deferred maintenance
1919 plans and receive implementation updates.
2020 (c) The committee is composed of six members as follows:
2121 (1) three members of the senate appointed by the
2222 lieutenant governor; and
2323 (2) three members of the house of representatives
2424 appointed by the speaker of the house of representatives.
2525 (d) The chair of the committee shall alternate annually
2626 between:
2727 (1) a member of the senate appointed by the lieutenant
2828 governor; and
2929 (2) a member of the house of representatives appointed
3030 by the speaker of the house of representatives.
3131 (e) The lieutenant governor shall appoint the first chair of
3232 the committee.
3333 (f) A vacancy on the committee shall be filled in the same
3434 manner as the original appointment.
3535 (g) The committee biannually shall provide a written report
3636 to the legislature that identifies:
3737 (1) the amount of money expended for deferred
3838 maintenance;
3939 (2) planned deferred maintenance projects; and
4040 (3) the status of ongoing and completed deferred
4141 maintenance projects.
4242 (h) The committee shall:
4343 (1) have the powers and duties of a joint committee
4444 created by proclamation; and
4545 (2) obtain funding in the same manner as a joint
4646 committee created by proclamation.
4747 (i) The rules adopted by the 86th Legislature for the
4848 administration of joint committees created by proclamation apply to
4949 the committee to the extent the rules are consistent with this
5050 section.
5151 (j) The committee is abolished and this section expires on
5252 September 1, 2025.
5353 SECTION 3. (a) If this Act receives the votes necessary for
5454 immediate effect, the lieutenant governor and the speaker of the
5555 house of representatives shall make appointments to the Joint
5656 Oversight Committee on Government Facilities not later than July 1,
5757 2019.
5858 (b) If this Act does not receive the votes necessary for
5959 immediate effect, the lieutenant governor and the speaker of the
6060 house of representatives shall make appointments to the Joint
6161 Oversight Committee on Government Facilities not later than
6262 September 15, 2019.
6363 SECTION 4. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2019.
