| 9 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 13 | | SECTION 1. Chapter 37, Penal Code, is amended by adding |

| 11 | 14 | | Section 37.082 to read as follows: |

| 12 | 15 | | Sec. 37.082. FALSE REPORT OF CRIMINAL CONDUCT COMMITTED BY |
|---|
| 13 | 16 | | EMERGENCY RESPONDER. (a) In this section, "emergency services |
|---|
| 14 | 17 | | personnel" has the meaning assigned by Section 22.01. |
|---|
| 15 | 18 | | (b) A person commits an offense if, with the intent to |
|---|
| 16 | 19 | | deceive, the person: |
|---|
| 17 | 20 | | (1) knowingly makes a false report that a peace |
|---|
| 18 | 21 | | officer or emergency services personnel, while performing official |
|---|
| 19 | 22 | | duties, engaged in conduct that violates a penal law of this state; |
|---|
| 20 | 23 | | and |
|---|
| 21 | 24 | | (2) makes the report to any law enforcement agency for |
|---|
| 22 | 25 | | the purpose of initiating a criminal investigation against the |
|---|
| 23 | 26 | | officer or personnel. |
|---|
| 24 | 27 | | (c) An offense under this section is a Class A misdemeanor. |
|---|
| 25 | 28 | | (d) If conduct that constitutes an offense under this |
|---|
| 26 | 29 | | section also constitutes an offense under another law, the actor |
