710 relating to the creation of the criminal offense of false report of
811 criminal conduct committed by emergency responder.
912 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1013 SECTION 1. Chapter 37, Penal Code, is amended by adding
1114 Section 37.082 to read as follows:
1215 Sec. 37.082. FALSE REPORT OF CRIMINAL CONDUCT COMMITTED BY
1316 EMERGENCY RESPONDER. (a) In this section, "emergency services
1417 personnel" has the meaning assigned by Section 22.01.
1518 (b) A person commits an offense if, with the intent to
1619 deceive, the person:
1720 (1) knowingly makes a false report that a peace
1821 officer or emergency services personnel, while performing official
1922 duties, engaged in conduct that violates a penal law of this state;
2023 and
2124 (2) makes the report to any law enforcement agency for
2225 the purpose of initiating a criminal investigation against the
2326 officer or personnel.
2427 (c) An offense under this section is a Class A misdemeanor.
2528 (d) If conduct that constitutes an offense under this
2629 section also constitutes an offense under another law, the actor
27- may be prosecuted under this section or the other law
28- .
30+ may be prosecuted under this section, the other law, or both.
2931 SECTION 2. This Act takes effect September 1, 2019.
