79 AN ACT
810 relating to students eligible to receive compensatory, intensive,
911 and accelerated instructional services.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 29.081(d), Education Code, is amended to
1214 read as follows:
1315 (d) For purposes of this section, "student at risk of
1416 dropping out of school" includes each student who is under 26 years
1517 of age and who:
1618 (1) was not advanced from one grade level to the next
1719 for one or more school years;
1820 (2) if the student is in grade 7, 8, 9, 10, 11, or 12,
1921 did not maintain an average equivalent to 70 on a scale of 100 in two
2022 or more subjects in the foundation curriculum during a semester in
2123 the preceding or current school year or is not maintaining such an
2224 average in two or more subjects in the foundation curriculum in the
2325 current semester;
2426 (3) did not perform satisfactorily on an assessment
2527 instrument administered to the student under Subchapter B, Chapter
2628 39, and who has not in the previous or current school year
2729 subsequently performed on that instrument or another appropriate
2830 instrument at a level equal to at least 110 percent of the level of
2931 satisfactory performance on that instrument;
3032 (4) if the student is in prekindergarten,
3133 kindergarten, or grade 1, 2, or 3, did not perform satisfactorily on
3234 a readiness test or assessment instrument administered during the
3335 current school year;
3436 (5) is pregnant or is a parent;
3537 (6) has been placed in an alternative education
3638 program in accordance with Section 37.006 during the preceding or
3739 current school year;
3840 (7) has been expelled in accordance with Section
3941 37.007 during the preceding or current school year;
4042 (8) is currently on parole, probation, deferred
4143 prosecution, or other conditional release;
4244 (9) was previously reported through the Public
4345 Education Information Management System (PEIMS) to have dropped out
4446 of school;
4547 (10) is a student of limited English proficiency, as
4648 defined by Section 29.052;
4749 (11) is in the custody or care of the Department of
4850 Family and Protective Services or has, during the current school
4951 year, been referred to the department by a school official, officer
5052 of the juvenile court, or law enforcement official;
5153 (12) is homeless, as defined by 42 U.S.C. Section
5254 11302, and its subsequent amendments; [or]
5355 (13) resided in the preceding school year or resides
5456 in the current school year in a residential placement facility in
5557 the district, including a detention facility, substance abuse
5658 treatment facility, emergency shelter, psychiatric hospital,
5759 halfway house, cottage home operation, specialized child-care
5860 home, or general residential operation;
5961 (14) has dyslexia or a related disorder; or
6062 (15) is educationally disadvantaged.
6163 SECTION 2. Section 33.151(4), Education Code, is amended to
6264 read as follows:
6365 (4) "Student at risk of dropping out of school" means:
6466 (A) a student at risk of dropping out of school as
6567 defined by Section 29.081; or
6668 (B) [a student who is eligible for a free or
6769 reduced lunch; or
6870 [(C)] a student who is in family conflict or
6971 crisis.
7072 SECTION 3. This Act takes effect immediately if it receives
7173 a vote of two-thirds of all the members elected to each house, as
7274 provided by Section 39, Article III, Texas Constitution. If this
7375 Act does not receive the vote necessary for immediate effect, this
7476 Act takes effect September 1, 2019.
