66 AN ACT
77 relating to the authority of an independent school district to
88 change the date of the general election and terms for officers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.059, Education Code, is amended by
1111 adding Subsection (e) to read as follows:
1212 (e) Not later than December 31, 2024, the board of trustees
1313 may adopt a resolution changing the length of the terms of its
1414 trustees. The resolution must provide for staggered terms of either
1515 three or four years and specify the manner in which the transition
1616 from the length of the former term to the modified term is made. The
1717 transition must begin with the first regular election for trustees
1818 that occurs after the board adopts the resolution, and a trustee who
1919 serves on the date the resolution is adopted shall serve the
2020 remainder of that term. This subsection expires January 1, 2030.
2121 SECTION 2. Section 41.0052, Election Code, is amended by
2222 adding Subsection (a-3) to read as follows:
2323 (a-3) The governing body of an independent school district
2424 that holds its general election for officers on a date other than
2525 the November uniform election date may, not later than December 31,
2626 2024, change the date on which it holds its general election for
2727 officers to the November uniform election date. This subsection
2828 expires January 1, 2025.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2019.
