| 7 | 7 | | relating to the requirements for issuing and renewing certain |
|---|
| 8 | 8 | | certificates and licenses to practice barbering. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 1601.265(a), Occupations Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) Subject to Section 1603.2545, the [The] department |
|---|
| 13 | 13 | | shall issue a license or certificate to an applicant for a license |
|---|
| 14 | 14 | | or certificate issued under Section 1601.253, 1601.256, or 1601.258 |
|---|
| 15 | 15 | | if the applicant: |
|---|
| 16 | 16 | | (1) submits an application on a form prescribed by the |
|---|
| 17 | 17 | | department; |
|---|
| 18 | 18 | | (2) pays the application fee; and |
|---|
| 19 | 19 | | (3) provides proof that the applicant holds a current |
|---|
| 20 | 20 | | license to engage in the same or a similar activity issued by |
|---|
| 21 | 21 | | another jurisdiction that has license requirements substantially |
|---|
| 22 | 22 | | equivalent to those of this state. |
|---|
| 23 | 23 | | SECTION 2. Section 1601.402, Occupations Code, is amended |
|---|
| 24 | 24 | | by adding Subsection (d) to read as follows: |
|---|
| 25 | 25 | | (d) Notwithstanding Subsection (c), a Class A barber or |
|---|
| 26 | 26 | | barber technician may not renew a certificate or license issued |
|---|
| 27 | 27 | | under Section 1601.253 or 1601.256 unless the person has passed an |
|---|
| 28 | 28 | | examination administered under Section 1603.2545. This subsection |
|---|
| 29 | 29 | | expires June 1, 2022. |

| 30 | 30 | | SECTION 3. Subchapter F, Chapter 1603, Occupations Code, is |
|---|
| 31 | 31 | | amended by adding Section 1603.2545 to read as follows: |
|---|
| 32 | 32 | | Sec. 1603.2545. EXAMINATION FOR CERTAIN CLASS A BARBER |
|---|
| 33 | 33 | | CERTIFICATE OR BARBER TECHNICIAN LICENSE APPLICANTS. An applicant |
|---|
| 34 | 34 | | under Section 1601.265 for a Class A barber certificate or barber |
|---|
| 35 | 35 | | technician license must pass an examination prescribed by the |
|---|
| 36 | 36 | | department. The content of the examination must focus on customer |
|---|
| 37 | 37 | | safety, including sanitary and hygiene requirements. |
|---|
| 38 | 38 | | SECTION 4. (a) Not later than December 1, 2019, the Texas |
|---|
| 39 | 39 | | Commission of Licensing and Regulation shall adopt rules necessary |
|---|
| 40 | 40 | | to implement the changes in law made by this Act. |
|---|
| 41 | 41 | | (b) The changes in law made by this Act with respect to the |
|---|
| 42 | 42 | | issuance of a certificate or license apply only to an application |
|---|
| 43 | 43 | | for the issuance of a Class A barber certificate or barber |
|---|
| 44 | 44 | | technician license submitted on or after January 1, 2020. An |
|---|
| 45 | 45 | | application for the issuance of a Class A barber certificate or |
|---|
| 46 | 46 | | barber technician license submitted before that date is governed by |
|---|
| 47 | 47 | | the law in effect immediately before the effective date of this Act, |
|---|
| 48 | 48 | | and the former law is continued in effect for that purpose. |
|---|
| 49 | 49 | | (c) Section 1601.402(d), Occupations Code, as added by this |
|---|
| 50 | 50 | | Act, applies only to a Class A barber certificate or barber |
|---|
| 51 | 51 | | technician license that expires on or after January 1, 2020. A |
|---|
| 52 | 52 | | certificate or license that expires before that date is governed by |
|---|
| 53 | 53 | | the law in effect on the date the certificate or license expired, |
|---|
| 54 | 54 | | and the former law is continued in effect for that purpose. |
|---|
| 55 | 55 | | SECTION 5. This Act takes effect September 1, 2019. |
