9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to providing for endorsements for public high school
612 students enrolled in special education programs.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 28.025, Education Code, is amended by
915 adding Subsections (c-7) and (c-8) to read as follows:
1016 (c-7) Subject to Subsection (c-8), a student who is enrolled
1117 in a special education program under Subchapter A, Chapter 29, may
1218 earn an endorsement on the student's transcript by:
1319 (1) successfully completing, with or without
1420 modification of the curriculum:
1521 (A) the curriculum requirements identified by
1622 the State Board of Education under Subsection (a); and
1723 (B) the additional endorsement curriculum
1824 requirements prescribed by the State Board of Education under
1925 Subsection (c-2); and
2026 (2) successfully completing all curriculum
2127 requirements for that endorsement adopted by the State Board of
2228 Education:
2329 (A) without modification of the curriculum; or
2430 (B) with modification of the curriculum,
2531 provided that the curriculum, as modified, is sufficiently rigorous
2632 as determined by the student's admission, review, and dismissal
2733 committee.
2834 (c-8) For purposes of Subsection (c-7), the admission,
2935 review, and dismissal committee of a student in a special education
3036 program under Subchapter A, Chapter 29, shall determine whether the
3137 student is required to achieve satisfactory performance on an
3238 end-of-course assessment instrument to earn an endorsement on the
3339 student's transcript.
3440 SECTION 2. This Act applies beginning with the 2019-2020
3541 school year.
3642 SECTION 3. This Act takes effect immediately if it receives
3743 a vote of two-thirds of all the members elected to each house, as
3844 provided by Section 39, Article III, Texas Constitution. If this
3945 Act does not receive the vote necessary for immediate effect, this
4046 Act takes effect September 1, 2019.
