55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to peace officer training on recognizing and recording
88 circumstances that indicate strangulation in certain cases.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1701.253(d), Occupations Code, is
1111 amended to read as follows:
1212 (d) Training in documentation of cases required by
1313 Subsection (b) shall include instruction in:
1414 (1) making a written account of the extent of injuries
1515 sustained by the victim of an alleged offense;
1616 (2) recording by photograph or videotape the area in
1717 which an alleged offense occurred and the victim's injuries; [and]
1818 (3) recognizing and recording a victim's statement
1919 that may be admissible as evidence in a proceeding concerning the
2020 matter about which the statement was made; and
2121 (4) recognizing and recording circumstances
2222 indicating that a victim may have been assaulted in the manner
2323 described by Section 22.01(b)(2)(B), Penal Code.
2424 SECTION 2. Section 1701.352(f), Occupations Code, is
2525 amended to read as follows:
2626 (f) Training in documentation of cases required by
2727 Subsection (b) shall include instruction in:
2828 (1) making a written account of the extent of injuries
2929 sustained by the victim of an alleged offense;
3030 (2) recording by photograph or videotape the area in
3131 which an alleged offense occurred and the victim's injuries; [and]
3232 (3) recognizing and recording a victim's statement
3333 that may be admissible as evidence in a proceeding concerning the
3434 matter about which the statement was made; and
3535 (4) recognizing and recording circumstances
3636 indicating that a victim may have been assaulted in the manner
3737 described by Section 22.01(b)(2)(B), Penal Code.
3838 SECTION 3. (a) Not later than January 1, 2020, the Texas
3939 Commission on Law Enforcement shall establish or modify training
4040 programs as necessary to comply with Section 1701.253, Occupations
4141 Code, as amended by this Act.
4242 (b) The minimum curriculum requirements under Section
4343 1701.253(d), Occupations Code, as amended by this Act, apply only
4444 to a peace officer who first begins to satisfy those requirements on
4545 or after January 1, 2020.
4646 SECTION 4. This Act takes effect September 1, 2019.
